HomeMy Public PortalAbout196CITY OF MEDINA ORDINANCE NO. / 9 G AN ORDINANCE ADOPTING THE MINNESOTA BUILDING CODE; PROVIDING FOR ITS ADMINISTRATION AND ENFORCEMENT; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HSIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF MEDINA; PRO- VIDING FOR THE ISSUANCE OF PERFECTS AND COLLECTION OF FEES THEREFORE; PROVIDING PEN- ALTIES FOR THE VIOLATION THEREOF; REPEALING ALL OTHER ORDINANCES AND PARTS OF ORDI- NANCES IN CONFLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF MEDINA DOES ORDAIN AS FOLLOWS: Section 1. Building Code. The Minnesota State Building Code, one copy of which is on file in the office of the City Clerk has been adopted by Minn. Stat. 16.851 (1977) as a Uniform Building Code applicable throughout the state. Such code is hereby confirmed as the Building Code of the City of Medina and incorporated in this Ordinance as completely as if set out in full. A. The 1980 Edition of the State Building Code adopts by reference the following codes: (1) 1979 Edition of the Uniform Building Code, identified as "UBC"; (2) 1978 Edition of the National Electric Code, identified as "NEC"; (3) (4) (5) 1978 American National Standard Safety Code for Elevators, Dumbwaiters, Escalators and Moving Walks, identified as ANSI A17.1 - 1978 and Sup- plement, ANSI A17.1a - 1979; 1979 Minnesota Plumbing Code, identified as PAID 120 through MHD 135; "Flood Proofing Regulations", June 1972, Office of the Chief of En- gineers, U. S. Army; (6) Minnesota Heating, Ventilating, Air Conditioning and Refrigeration Code, identified as SBC 7101 through SBC 8505; (7) "Design and Evaluation Criteria for Energy Conservation in New Building, Additions and Remodeled Elements of Building and Standards for Certain Existing Public Buildings", identified as 2MCAR Section 1.16001 through 2MCAR Section 1.16006; State of Minnesota Mobile Home Installation Standards 1977, identified as 2MCAR 1.90450 installations and related definitions in 2MCAR 1.90103; Standards of Performance for Solar Energy Systems and Subsystems Applied to Energy Need of Buildings, 1977 Edition, identified as 2MCAR 1.16101 through 2MCAR 1.16108. B. In addition to those items listed above, Supplemental Materials referenced in the as part of the Building Code of the City Ordinance as completely as if set out in to the following: certain Appendices, Standards and Code are hereby adopted by reference of Medina and incorporated into this full, including but are not limited (1) Technical Requirements for Fallout Shelters, identified as SBC Appendix "A". (2) Variations in Snow Loads, identified as Minnesota State Building Code, Appendix B. (3) 1979 Uniform Building Code Appendix Chapter 35. (4) Minnesota Plumbing Code Appendix B. Section 2. Organization and Enforcement. The organization of the Building Depart- ment and enforcement of the Code shall be conducted within the guidelines es- tablished by Chapter 2 of the Uniform Building Code 1979 Edition. (The code shall be enforced within the incorporated limits of the City and extraterritorial limits permitted by Law.) The Board of Appeals shall be the City Council. The City Building Inspector shall be the Building Code Department of the City of Medina. The Administrative Authority shall be a State Certified "Building Official" so designated by the Appointing Authority. The Appointing Authority shall be the Council of the City of Medina. Section 3. A. Permits, Inspections and Fees. The issuance of permits, conduction of in- spections and collection of fees shall be as provided for in Chapter 3 of the Uniform Building Code. (Note: A fee schedule for such permits and in- spections is to be established at the option of the local unit of government.) Table 3-A may be adopted as is or can be used as a guideline for a schedule of fees. It should be kept in mind that fees are a legal method of financing the Building Code Department. Fees may be established to encompass the entire construction disciplines or separate fees may be established for the units individually i.e. Building, Plumbing, HVAC and electrical when such electrical inspection is not done by the State Board of Electricity. The maximum fee for a permit for a single family dwelling in other than cities is established by Minnesota Law and shall not exceed the greater of $100.00 or .005 times the value of the structure, addition or alteration. B. Surcharge. In addition to the permit fee required by Item 1 above, the ap- plicant shall pay a surcharge in the amount fixed by Law. The amount required by Law shall be remitted quarterly (or monthly) to the Minnesota Department of Administration. Section 4. Violations and Penalties. The penalty described in the Uniform Building Code, 1979 Edition, Section 205 as amended shall be in keeping with Minnesota Statutes 609.031 which provides for a maximum fine of $500.00 or imprisonment for 90 days, or both. Section 5. Effective Date of Ordinance. This Ordinance becomes effective upon its adoption and Publication. Adopted by the Council of the City of Medina this 16th day of Sept tuber 1980.
