RESOLUTION NO. 03 -4156
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
AUTHORIZNG THE CITY MANAGER TO SUBMIT AN APPLICATION FOR A
CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY
DEVELOPMENT GRANT.
WHEREAS, the City of Temple City recognizes the need and advocates the use of ari
interdisciplinary approach to proactive code enforcement which effectively uses the human
resources of all members of City staff, the Los Angeles County Building and Safety Department,
the Los Angeles County Sheriffs Department, the Los Angeles County Fire Department and the
Los Angeles County Health Department in preventing hazardous conditions, abating nuisances
and achieving code compliance; and
WHEREAS, the City of Temple City finds and determines that through a cooperative and
effective working relationship between such agencies, the public, and the. City, the existing
housing stock in the City may be more effectively repaired, preserved, and protected; and
WHEREAS, the proactive investigation, pursuit, and resolution of code enforcement
matters is critical for the preservation of community aesthetics, maintenance and improvement of
the public health, safety, and general welfare; and
WHEREAS, the City Manager of the City of Temple City wishes to apply for and receive
an allocation of funds through the Code Enforcement Grant Program to assist in achieving such
goals; and
WHEREAS, the California Department of Housing and Community Development (herein
referred to as "HCD" has issued a Notice of Funding Availability ( "NOFA ") for the Code
Enforcement Grant Program established by SB 1227 Burton (Chapter 26 of the Statues of 2002),
Health and Safety Code section 53533(a)(6). Pursuant to the statute, HCD is authorized to
approve funding allocations for the program, subject to the terms and conditions of the NOFA and
program application forms.
NOW THEREFORE, the City Council of the City of Temple City does hereby resolve as
follows:
SECTION 1. The City Manager is hereby authorized to submit to HCD an application to
participate in the Code Enforcement Grant Program in response to the NOFA issued February
14, 2003, which will request a funding allocation in the amount not to exceed $300,000 for the
purchase of capital assets identified in the application to be used in the City of Temple City. The
application also commits the applicant to use, support, and maintain the capital assets acquired
with grant funds for at least three years.
SECTION 2. If the application for funding is approved, the City Manager hereby agrees
to use the funds for eligible capital asset(s) in the manner presented in the application as
approved by HCD and in accordance with the NOFA and application package. R also may
execute any and all instruments required by HCD for participation in the Code Enforcement
Program.
SECTION 3. The City Manager is authorized to execute in the name of the City the
application, the Standard Agreement, and all other documents required by HCD for participation
in the Code Enforcement Grant Program.
