Aa - A RESOLUTION CONCERNING CERTAIN STREETS IN THE CITY OF McCALL ESTABLISHED BY PRESCRIPTION; MAKING CERTAIN FINDINGS AND DIRECTING THE CITY ATTORNEY TO INSTI'2UTE LEGAL ACTION TO ESTABLISH THE VALIDITY AND EXISTENCE THEREOF. WHEREAS, certain streets in the City of McCall have been established by adverse, continuous, uninterrupted and exclusive use by the. public and the supervision and maintenance thereof by the City of McCall, for many years and that such streets have been established by prescription as public streets of the City of McCall. WHEREAS, claim is being made by one Sam Kalman to the ownership, use and possession of such streets; WHEREAS, such streets are shown on the maps thereof attached hereto as Exhibit "A" and by this reference made a part hereof; WHEREAS, the public interest, convenience and necessity require that the city take such action that may be required in order to preserve, protect and maintain such streets as open public streets of the City of McCall. NOW, THEREFORE, BE IT RESOLVED, that the city attorney be and he is hereby authorized and directed to institute such legal proceedings as may be appropriate to seek judgment that such streets are public streets of the City of McCall, under the exclusive care, supervision and control of the City of McCall, Idaho.
