RESOLUTION NO. 73-- r , SUPPORTING PREPARATION OF A JOINT POWERS
AGREEMENT FOR MUNICIPALITIES IN THE ELM CREEK DRAINAGE BASIN
WHEREAS the Village of Medina is partially within the Elm Creek
drainage basin and experiences common water management, soil,
sedimentation, and land use management problems with other munici-
palities within the basin; and
WHEREAS the Hennepin County Soil and Water Conservation District has
available staff support to assist municipalities in planning solutions
to such problems; and
WHEREAS state law authorizes municipalities jointly or cooperatively
to exercise their common powers in addressing such problems, and
federal and state funds are available for implementation of proposed
improvements or solutions; and
WHEREAS it is in the best interests of the Village of Medina to
develop solutions to the aforementioned problems jointly and coopera-
tively with adjacent or nearby municipalities without establishment
of a new, overlapping or special purpose taxing district;
NOW, THEREFORE, BE IT RESOLVED:
1. That the Village of Medina agrees to support preparation of a joint
powers agreement among municipalities in the Elm Creek drainage basin
and the Hennepin County Soil and Water Conservation District for
purposes of dealing with the aforesaid problems, which agreement shall
deal with staff functions, organization, types of activity and planning
desired, purpose in detail, length of term, termination and withdrawal,
distribution of property and finances; and
2. That the Village of Medina appropriates an amount not to exceed
$87.00 to cover its proportionate share of expenses for preparation
of said agreement; and
3. That d erelcl Pykhaf is hereby designated to participate in the
formulation of this agreement on behalf of the Village of Medina.
