Upon reviewing the canvass of the special municipal general '
obligation bond election held in the City of McCall, Idaho, on
• June ' 6 , 1989 , and proceedings subsequent thereto, from which it
appears that in order to market, the bonds .authorized at •such
election, that a judicial validation of such election and the
proceedings taken thereafter, is deemed advisable.
• NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council
of the City of McCall, Idaho, that ROBERT H. RE4AKLUS, Lawyer
P.A. ,. McCall city attorney, and Michael Moore, of Lindsay,
Hart, Neil & Weigler, bond counsel 'for the . City of McCall, be
and are hereby authorized and directed, to file a petition -pur-
suant
etition pur-suant to Sections 7-1301, et seq. , Idaho Code, in the District
Court of the Fourth Judicial District of the, State of. Idaho,
•
in and for the County of Valley, seeking a judicial examination '
and determination of the validity of (i) the special municipal
general obligation bond election o.f. June 6 , 1989 ; (ii) the
declaration o-f theCity. Council: of McCall of the validity
thereof and of the approval of the proposition for the issuance
of. bonds by the requisite two-thirds majority of the qualified
electors voting• at said •speci'al bond election; and (iii) Ordi-'
nance No. 553 , adopted by the Mayor. and Council of_.. McCall on
July 13, 1989 , authorizing the issuance and sale of. the general
• obligation 'bonds' of the City of' McCall for the .purpos.es expressed
therein; and a declaration that the general obligation bonds of
the City of McCall, when issued -pursuant to said Ordinance '.No.
553, will be valid and enforceable general obligations of
the City of McCall, Idaho.
