RESOLUTION NO. 7?,--g
RESOLUTION REVISING SITE AND BUILDING PLANS
OF MEDINA PROPERTIES, INC,
WHEREAS, on April 3, 1973, the Medina Village Council revoked
the building permit on Lot 8, Block 2, Medina Industrial Park Second
Addition and prohibited a certificate of occupancy on Lot 12, Block 2,
Medina Industrial Addition, Hennepin County and;
WHEREAS, Medina Properties, Inc. has submitted a new develop-
ment plan, revised Site Plan and request for variance on the subject parcels,
together with Lots 4 and 5, Block 1, Medina Industrial Park Second Addition;
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
Village of Medina that the Resolution of April 3, 1973, revoking the building
permits and certificates of occupancy as aforesaid be and the same are
hereby rescinded, but subject to the following conditions:
1. That the parking spaces and truck loading spaces be con-
structed as set forth on the Composite Site Plan submitted
by the developer and which is attached hereto and made a
part hereof by reference.
2. That all outside storage of materials on the properties
shown on the Composite Site Plan be eliminated at or
before the time the certificate of occupancy is issued
on Lot 12, Block 2, Medina Industrial Addition.
3. That blacktop surfacing and parking lot striping be
installed in all parking, driving, loading and circulation
areas of Lots 5 and 12 prior to July 15, 1973.
4. That boulevard areas, rear yard and side yard areas
not receiving blacktop treatment be finished with an
aggregate material approved by the Zoning Administrator
prior to September 30, 1973. Further, that sidewalks
as indicated on said Composite Site Plan be installed on
Lot 5 and 12 prior to July 15, 1973. That the same
surfacing materials be applied to Lot 8, before a
certificate of occupancy shall be issued,
5. That the Southerly 12 feet of Lot 4 be improved with
grading and a gravel base approved by the Zoning
Administrator, said gravel base to be installed on or
before July 15, 1973 and maintained as an access route
for emergency vehicles until such time as Lot 4 is
developed, including the permanent installation of
blacktop on the Southerly 12 feet thereof.
6. That Kilkenny Lane and Tower Drive be improved with
grading and at least granular base no later than
September 30, 1973 to the extent necessary to provide
vehicular access to the buildings on Lot 5, 8 and 12.
7. That curb cuts for vehicular access to all lots be as
set forth on the Composite Site Plan, provided however,
that the location of the curb cut at the Southeast corner
of Lot 8 be subject to the approval of the Zoning
Administrator. That a variance from Section 27 (f) 3
of the Medina Zoning Code be granted to allow for the
construction of a retaining wall 50 feet in length and
approximately 5.4 feet in height on the boundary line
between Lot 5 and 12 as indicated on the Composite
Site Plan. The grades between Lots 5 and 12 shall
be established to provide for emergency access to the
North of the buildings on said Lot and vehicular access
between the two parking lots to the South of said buildings.
8. That variances also be granted to allow for the construction
of loading docks in the set back area Northerly of the
building on Lot 5 and Easterly of the building on Lot 12
on the condition that emergency vehicular access be
provided on the Northerly 15 feet of Lot 12, the Northerly
15 feet of Lot 5 and the Southerly 4 feet of Lot 4 and
conditioned further that no permanent structure of any
kind located on the Southerly 12 feet of Lot 4.
9. That the truck loading area on the Westerly side of the
building on Lot 5 will be eliminated.
10. That all other construction on the site conform to the
Composite Site Plan attached hereto.
RESOLVED FURTHER, that the said variances are granted upon the
finding by the Village Council that the lots in question are small in size and
the topography slopes sharply to the East creating difficulties in establishing
a parking and circulation pattern.
