HomeMy Public PortalAbout1973-010fe-A- - Member S&A., pg-A-Sia-c-L,Lc_ introduced the following resolution and moved its adoption: RESOLUTION NO, ? 3 -.yaw RESOLUTION REVISING SITE AND BUILDING PLANS OF MEDINA PROPERTIES, INC, WHEREAS, on April 3, 1973, the Medina Village Council revoked the building permit on Lot 8, Block 2, Medina Industrial Park Second Addition and prohibited a certificate of occupancy on Lot 12, Block 2, Medina Industrial Addition, Hennepin County and; WHEREAS, Medina Properties, Inc. has submitted a new development plan, revised Site Plan and request for variance on the subject parcels, together with Lots 1 and 4, Block 1, Medina Industrial Park Second Addition; NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Medina that the following actions be taken: 1. Parking Layout 2. Truck Loading Areas 3. Outside Storage of Materials 4. Surfacing Lots 5, 8 and 12 5. Gravel base on Lot 4 6. Street Improvements a -C Cc Det. 7. Variance for Placement of Retaining Wall / 8. Variance and building permit for Loading Dock on Lot 5, Block 1, Medina Industrial Second Addition 9. Variance for Loading Dock on Lot 12, Block 2, Medina Industrial Addition 10. Additional Conditions Imposed 11. Disposition of Stop Order e ATTEST: Clerk The motion for the ad member Mayor ton of the foregoing resolution was duly seconded by and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same; TO THE VILLAGE COUNCIL VILLAGE OF MEDINA Medina Properties, Inc. requests final site plan approval for Lot 12, Block 2, Medina Industrial Addition; Lot 5, Block 1 and Lot 8, Block 2, Medina Industrial Second Addition together with preliminary site plan approval for Lot 4, Block 1, Medina Industrial Second Addition. The purpose of the request for approval is to satisfy the deficiencies noted by the Village Council in its Resolution of April 3, 1973. Correction of the deficiencies is as noted on the Composite Site Plan which is submitted herewith. In addition to the matters shown on the Composite Site Plan and in clarification thereof, Medina Properties agrees to the following alterations and construction detail on the several sites. 1. All parking layouts have been altered to provide the number of parking spaces required by the Ordinance in a way that will eliminate parking in front of doors designed for truck or loading access. Parking has also been eliminated in front of loading docks. 2. Truck loading spaces have been provided at all loading areas in addition to the required parking spaces. 3. Since each site is largely covered with building, parking spaces, loading areas, pedestrian walkways, and setback areas, the out door storage of materials will be eliminated. However, since one of the present tenants of Lot 5 has materials stored on the parking lot at Lot 5, and since that tenant is moving into the building on Lot 12, we request permission to continue such out door storage until a certificate of occupancy is obtained for the building on Lot 12. 4. The surfacing of Lots 5, 8 and 12 will be accomplished as follows: a. Blacktop surfacing will be installed in all parking, driving, loading, and circulation areas of Lots 5 and 12 prior to July 15, 1973. The boulevard areas, the rear yard and side yard areas not receiving blacktop treatment will receive crushed rock or gravel treatment (as the Council approves) on Lots 5 and 12 by September 30, 1973. Sidewalks as indicated on the site plans for Lots 5 and 12 will be completed before the /50 day of Jj / y , 1973. 5. The same surfacing materials will be applied to Lot 8, to be installed before a certificate of occupancy is issued. 6. A gravel base will be applied to the Southerly 12 feet of Lot 4 to provide emergency vehicular access around the loading dpck and ramp to the rear of the building on Lot 5. This gravel strip will b'e maintained for such emergency access until such time as the building is constructed on Lot 4 and permanent blacktop surfacing installed, said gravel strip to be installed by the /f day of vrei y , 1973. 7. Kilkenny Lane and Tower Drive will be improved with grading and granular base no later than September 30, 1973, at least to the extent necessary to provide access to the buildings on Lots 5, 8 and 12. 8. Lots 5, 8 and 12 will have street access on each end of the parking and driving areas, the access to be provided at the boundary line of the adjoining lots to cut down on the number of curb cuts involved. In addition, the retaining wall shown on prior plans between the buildings on Lots 5 and 12 will be partially eliminated to provide a 22 foot access directly between the Lots 5 and 12. The retaining wall will also be eliminated on the Northerly 15 feet of Lots 5 and 12 to provide free access for emergency vehicles, if necessary, along the rear of the buildings on Lots 5 and 12. It is requested that a variance be granted from Section 27 (f)(3) of the Medina Zoning Code to allow for the construction of a retaining wall 80 to 85 feet in length and approximately feet in height on the boundary line between Lots 5 and 12 as indicated on the attached Composite Site Plan. It would be a hardship to build the retaining wall three feet back from the property line since it would eliminate the truck loading area. 9. Variances are also requested for the loading dock shown to the East of the building on Lot 12 and to the North of the building on Lot 5. It is submitted that Medina Properties will provide for emergency vehicle access to the North of the buildings on Lot 5 and 12 by means of the gravel base being provided on the Southerly 12 feet of Lot 4, Block 1, Medina Industrial Second Addition. A building permit is also requested for the loading dock and ramp on the Northerly side of the building on Lot 5. It is further agreed that no permanent structure will be placed on the Southerly 12 feet of Lot 4, Block 1, Medina Industrial Second Addition to guarantee such emergency vehicular access. 10. The truck loading area on the West side of the building on Lot 5 will be eliminated. It is requested that the stop orders placed on building permits and certificates of occupancy as indicated in the Council Resolution dated April 3, 1973.be withdrawn in consideration of the foregoing.
