Home My Public Portal AboutOrd. 06-60 ®ròinmtce No 06-60_ of t~e Ißorou£~ of OIaderd, ~ ~ W ~ Councilman Presents the following Ordinance Seconded by Councilm n AN ORDINANCE OF THE BOROUGH OF CARTE DESIGNATING THE CARTERET REDEVELOPMENT GENCY AS THE REDEVELOPMENT ENTITY FOR THE WASH A VENUE REDEVELOPMENT DISTRICT WHEREAS, on March 3, 2005, in accordance with the Redevelop ent and Housing Law, constituting Chapter 79 of the Pamphlet Laws of 1992 of the tate, and the acts amendatory thereof and supplemental thereto (the "Redevelopment La ", as codified in NJ.S.A. 40A: 12A-I ~ g:g.), the Borough of Cartcret, a municipal orporation in the County of Middlesex and the State of New Jersey (the "Boroug "), duly adopted ResoJution No. 05-93 authorizing the Planning Board of the Boroug (the "Board") to conduct a prcliminary investigation to determine whether the area w thin the Borough, comprised of sixty-four properties within BJocks 149, 186,212,213, 14,215,206,208, 219, 220, 221 and 222 (the "Washington Avenue Redcvelopme t District"), is a redevelopment area pursuant to the Redevelopment Law and direc ing the Board to prepare a redevelopment plan for the Washington Avenue Redevelo ment District (the "Washington Avenue Redevelopment PJan"); and WHEREAS, on November 30, 2005, the Board, in accordance with he Redevelopment Law, held a hearing (the "Hearing"), open to the public, at which Hea ing all members of the public were given the opportunity to be heard, with regards to th determination that the W ashington Avenue Redevelopment District is a redevelopment ar a; and WHEREAS, on December 21,2005, the Board duly adopted a resolu ion recommending to the Borough Council that the Washington Avenue Redevel pment District be designated as a redevelopmcnt area pursuant to the Redevelopment L wand transmitting tbe Washington Avenue Redevelopment Plan to the Borough Council· and WHEREAS, on January 12, 2006, tbe Borough duly adopted Re olution No. 06-38 declaring the Washington Avenue Redevelopment District to be a edevelopment area pursuant to the Redevelopment Law; and WHEREAS, on March 21, 2006, the Clerk of the Borough, in ceordance with the Redevelopment Law, specifically NJ.S.A. 40AI2A-6(b)(5), trar smitted a copy of Resolution No. 06-38 to tbe Commissioner of State's Department of ommunity Affairs; and WHEREAS, on June IS, 2006, in accordance with tbe Redcvelopm nt Law, the Borough finally adopted Ordinance No. 06-33, entitled "AN ORDINAN E TO ADOPT A REDEVELOPMENT PLAN FOR THE W ASHIN TON AVENUE REDEVELOPMENT DISTRICT IN THE BOROUGH OF CART RET", adopting the Wasbington Avenue Redevelopment Plan; and WHEREAS, on December March 29, 2006, the Board duly a opted a resolution recommending to tbe Borougb Council that the Borough Council a opt the Washington A venue Redevelopment Plan; and WHEREAS, the Borough seeks to provide for the implementatio of the Washington Avenue Redevelopment Plan; and WHEREAS, pursuant to the Redevelopment Law, specifically N..J S.A. 40A:12A-4, the Borough may designate a municipal redevelopment agency to act s the redevelopment entity for purposes of undertaking activities associated with the Washington Avenue Redevelopment Plan; and 06-60 PAGE 7 NO II \VHEREAS, on February I, 2001, and in accordance with the Redevelopment Law, speelfieally NJ.S.A. 40A:12A-ll, the Borough finally adopted Ordinance No. 01-1, which estabhshed the Carteret Redevelopment Agency (the "Agency") as an instrumentality of the Borough; and \VHEREAS, the Borough seeks to designate the Agency as its redevelopment entity for the Washington Avenue Redevelopment District to implement the Washington Avenu",- Redevelopment Plan and perfom1 redevelopment services in cOlli1ection with the Washington Avenue Redevelopment District; and NOW, THEREFORE, BE IT ORDAINED AND ENACTED hy the Borough Council of the Borough of Carteret, County of Middlesex, New Jersey (not less than two-thirds of all members thereof affim1atively concurring), as follows: Section 1. The Agency is hereby designated as the Borougb's redevelopment entity for the Washington Avenue Redevelopment District for al1 purposes of law, incJuding witbout limitation, the Redevelopment Law, and is hereby authorized to exercise al1 of the functions of a redevelopment entity, in accordance wlth the Redevelopment Law, as directed by the Borough. Section 2. Each of the Mayor or the Chief Financial Officer of the Borough (each an "Authorized Officer") are bereby authorized and directed to (i) execute and deliver, and the Borougb Clerk is hereby further authorized and directed to attest to such execution and to affix the corporate sea1 of the Borough to, any agreement, document, instrument or certificate deemed necessary, desirable or convenient by the Authorized Officers or the Borough Clerk, as applicable, in their respective sole discretion, after consultation with the such counsel and any advisors to the Borough (collectively, the "Borough Consultants"), to he executed in connection with the designation of the Agency as the redevelopment entity for the Washington A venue Redevelopment District, the implementation of the Washington A venue Redevelopment Plan, and the consummation of the transactions contemplated thereby, which detennination shall be concJusively evidenced by the execution of each such agreement, document, instrument or certificate by the party authorized hereunder to execute such agreement, document, instrument or certificate, and (ii) perform such other actions as the Authorized Officers deem necessary, desirable or convenient in relation to the execution and delivery thereof. Section 3. All actiollS of the Authorized Officers and the Borough Consultants taken prior to the date of adoption hereof in cOIUlection with the Washington Avenue Redevelopment District and the implementation of the Washington Avenue Redevelopment Plan are herehy ratified and approved.
