RESOLUTION NO, 73- /iI
RESOLUTION ORDERING THE RAZING AND REMOVAL
OF DILAPITATED BUILDING ON LOT 6, BLOCK 8,
INDEPENDENCE BEACH, HENNEPIN COUNTY.
WHEREAS, Eugene C. Koch is the record owner of property
legally described as Lot 6, Block 8, Independence Beach, Hennepin County,
located in the Village of Medina; and
WHEREAS, one Earnest Cunningham may have an interest in
such property; and
WHEREAS, Russell Bouley Jr., Medina Building Inspector
inspected said property and found that the foundation and basement wall
was buckled and caved in and that the basement is filled with water; that
the furnace and plumbing are inoperable; that the building contains open
stairways, rotting sills and floors, leaking and rotting roofs and a garage
which is filled with debris and is leaning to one side; and
WHEREAS, the said Building Inspector, upon inspecting the
building, a one story house with basement and garage, on May 23, 1973
formed the opinion that the building was in a state of complete deterioration
and could not be brought up to building code standards;
NOW, THEREFORE, BE IT RESOLVED that Eugene C. Koch and/
or Earnest Cunningham shall be ordered to raze and remove the dilapitated
structure legally described as Lot 6, Block 8, Independence Beach, Hennepin
County, said action being taken pursuant to Minnesota Statutes 463.15 - 463.26
on the grounds that said building is a hazardous building within the meaning
of that Statute;
BE IT FURTHER RESOLVED that the said Eugene C. Koch and/or
Earnest Cunningham, their heirs and assigns, must comply with this order
within twenty (20) days from the date of service thereof upon them or within
twenty (20) days therefrom file an answer thereto, or a motion for summary
enforcement of this order will be taken by the Village of Medina in the Hennepin
Countyct Cour�t,—
