HomeMy Public PortalAbout08-1993-8 ? riou Ao, /619.3 -g RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GREENCASTLE, INDIANA WHEREAS, the City of Grencastle, Indiana has passed ORDINANCE NO. J V-/ being an ORDINANCE AUTHORIZING THE CITY OF GREENCASTLE TO ISSUE ITS "TAXABLE ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 1993 A (INDIANA ASBURY TOWERS UNITED METHODIST HOME, INC. PROJECT) " AND APPROVING OTHER ACTIONS IN RESPECT THERETO; and WHEREAS, the City of Greencastle, Indiana has passed ORDINANCE NO. l 9 3- Z being an ORDINANCE AUTHORIZING THE CITY OF GREENCASTLE TO ISSUE ITS "ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 1993 B (INDIANA ASBURY TOWERS UNITED METHODIST HOME, INC. PROJECT) " AND APPROVING OTHER ACTIONS IN RESPECT THERETO; and WHEREAS, these two (2) Ordianances are for the issuance of economic development revenue bonds concerning the refinancing and the construction of three (3) additional floors to the existing ( facility at 102 West Poplar Street in the City of Greencastle, Indiana, commonly known as Asbury Towers; and WHEREAS, it has recently come to light that there is a 0 certain alley running on the south side of Lots 83 and 86 and on the north side of Lots 84 and 85, twelve (12) feet in width, as platted in the Original Plat of the Town (now City) of Greencastle, Indiana; and WHEREAS, said Asbury Towers is built over part of said twelve (12) foot alley; and WHEREAS, said Asbury Towers has been located over part of said alley for a period of approximately thirty (30) years; and WHEREAS, a check of the public records in the Courthouse in Greencastle, Indiana and the records in the City Hall of Greencastle, Indiana did not reveal any action closing or vacating said alleyway; and r WHEREAS, The Common Council of the City of Greencastle knows of no reason on the date of the passing of this Resolution why said alleyway should not be closed or vacated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCEL OF THE CITY OF GREENCASTLE, as follows: 1. That the Common Council of the City of Greencastle will favorably consider any request filed by Indiana Asbury Towers United Methodist Home, Inc. requesting the closing or vacating of said alleyway. 2 . That the Common Council of the City of Greencastle understands that in passing this resolution that it is in no way obligated or bound to close or vacate said alleyway. 3 . That this resolution is passed as a resolution of intent based on the circumstances existing on the date this resolution was made. The Common Council of the City of Greencastle realizes that there may be other circumstances to be addressed during any proceedings before it concerning the closing or vacating of said alleyway.
