HomeMy Public PortalAboutResolution 18-93 Appointing an engineer for local improvement district no.3 RESOLUTION NO. 18-93 A RESOLUTION OF THE CITY OF MCCALL, IDAHO, APPOINTING AN ENGINEER FOR LOCAL IMPROVEMENT DISTRICT NO. 3; FIXING THE TIME AND PLACE OF HEARING ON THE LOCAL IMPROVEMENT DISTRICT NO. 3 ASSESSMENT ROLL; PROVIDING FOR PUBLICATION AND MAILING OF NOTICE THEREOF; AND PROVIDING FOR OTHER MATTERS RELATING THERETO WHEREAS, Local Improvement District No. 3 ("L.I.D. No. 3") of the City of McCall (the "City") was created by Ordinance No. 630, adopted by the City Council (the "Council") on May 13, 1993; and WHEREAS, Idaho Code §§ 50-1710 and 50-1712 authorize the Council to appoint an engineer to prepare a duly certified report showing the total cost and expenses of the improvements and the dollar amounts of the same payable from assessments; and WHEREAS, the City is desirous of appointing Toothman-Orton Engineering Co. as engineer for L.I.D. No. 3 . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MCCALL, IDAHO, as follows: Section 1: Toothman-Orton Engineering Co. , of Boise, Idaho, is hereby appointed as engineers for L. I.D. No. 3, and shall prepare a duly certified report showing in detail the costs and expenses of the improvements and the dollar amounts of the same payable from assessments. Section 2 : The form of assessment roll for L.I.D. No. 3 prepared by the aforementioned engineer shall be filed in the office of the City Clerk, where it shall be available for public inspection during normal business hours. jitection 3 : Thursday, the 8th day of July, 1993, at the hour of 8: 00 P.M. , at the regular meeting place of the Council, City Hall, 216 Park Street, McCall, Idaho, is hereby fixed as the date, time, and place when and where the Council will meet in open session for the purpose of considering Toothman-Orton Engineering Co. 's report on the assessment roll and hearing any objections to the assessment roll by the owner of property within L.I.D. No. 3 . Section 4: The City Clerk shall give notice of the hearing specified in Section 3 above by publication of notice, substantially in the form set forth in Exhibit "A" which is annexed hereto and by reference made a part of this resolution, in the official newspaper of the City, once a week for two successive weeks, the first such publication being at least fifteen (15) days before the date fixed for hearing objections to the assessment Page 1 roll. The City Clerk shall also, not less than fifteen (15) days before the date fixed for hearing objections to the assessment roll, mail notice of the hearing, substantially in the form set forth in Exhibit "B" which is annexed hereto and by reference made apart of this resolution, to the owner of the property, or his or her agent, within the limits of L.I.D. No. 3, addressed to such person at his or her post office address, if known, or, if unknown, to the main post office in the City of McCall, Idaho. The mailed notice shall state the amount of the individual assessment as shown on the preliminary assessment roll. Section 5: The owner of any property which is assessed in said assessment roll, whether named in said assessment roll or not, may, within the time specified in the notice before the date and time fixed for the hearing, file with the City Clerk his or her objections in writing to said assessment. The assessment roll is on file in the office of the City Clerk at the above address, and is available for inspection by the public. At the hearing, the Council will hear and determine all objections to the regularity of the proceedings in making assessments, the correctness of assessments, and the amount levied on particular lots or parcels in relation to the benefits accruing thereon and in relation to the proper proportionate share of the total cost of the improvements. The owner of property within Local Improvement District No. 3 is hereby further notified that in revising the assessment roll at or after the hearing, the Council may increase any assessment or assessments up to twenty percent (20%) of the original amount thereof without giving further notice and holding a new hearing thereon. Each owner of any property which is assessed in the assessment roll, whether or not named in the assessment roll, may, until 5: 00 P.M. on Thursday, the 8th day of July, 1993 , file with the Clerk objections in writing to said assessments.
