A RESOLUTION REQUIRING CITIZENS REQUESTING
VACATIONS OF PUBLIC RIGHTS-OF-WAY BE
REPRESENTED BY COUNSEL
WHEREAS, Citizens of the City of Greencastle request vacations of public rights-of-
way; and
WHEREAS, such vacations of public rights-of-way are generally of benefit to those
persons so requesting; and
WHEREAS, vacation of public rights-of-way is a legal process whereby the interest of
the public is relinquished in favor of those persons requesting vacations; and
WHEREAS, the City Attorney must represent the best interest of the City in a
vacation of public rights-of-way; and
WHEREAS, the cost of a vacation of a public right-of-way should be borne by the
persons so benefitting.
NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF GREENCASTLE that any person requesting a vacation of public rights-of-way be
represented by private counsel and that the City Attorney represent the interest of the City
in any vacation of public rights-of-way.
PASSED AND RESOLVED by the Common Council of the City of Greencastle at
its regular meeting this day of , 1994.
