HomeMy Public PortalAbout12-1995-12 RESOLUTION 1995-12 A RESOLUTION AUTHORIZING AN INTER-LOCAL AGREEMENT BETWEEN THE CITY OF GREENCASTLE AND GREENCASTLE TOWNSHIP FOR THE PURCHASE OF A FIRE TRUCK DESIGNATED ENGINE #2 WHEREAS, it is in the best interest of the City of Greencastle and Greencastle Township to enter into a joint agreement for the purchase of a new fire truck and, WHEREAS, I . C. 36-1-7-1 and following sets out the authorizations and requirements for such agreement . BE IT THEREFORE resolved that the Greencastle Board or Works be authorized to enter into an agreement with Greencastle Township as follows : SEE ATTACHED INTER-LOCAL AGREEMENT BETWEEN THE CITY OF GREENCASTLE AND GREENCASTLE TOWNSHIP FOR THE JOINT PURCHASE OF A FIRE TRUCK DESIGNATED ENGINE #2 PASSED AND RESOLVED by the Common Council of the City of Greencastle at a special meeting this ,;' day of May, 1995 . Harmless, Mayor ATTEST: Judith Berry, CMC, Clerk-Treasurer grNn\a\resolut.12 INTER-LOCAL AGREEMENT BETWEEN THE CITY OF GREENCASTLE AND GREENCASTLE TOWNSHIP FOR THE JOINT PURCHASE OF A FIRE TRUCK DESIGNATED ENGINE #2 WHEREAS, the City of Greencastle and Greencastle Township desire to enter into an agreement to purchase a new fire truck. The parties therefore enter into the following agreement oursuant to I .C. 36-1-7 : 1 . This agreement shall continue so long as there is outstanding purchase debt on the fire truck, designated engine #2 . 2 . The purpose of the this joint agreement shall be fcr the joint purchase of a new fire pumper and general purpose fire truck which shall hereafter be designated Engine #2 . 3 . The expected cost of the fire truck is approximately Two Hundred and Fifty-One Thousand Dollars ($251, 000 . 00) and the parties agree that each will contribute Ninety-Seven Thousand Dollars ($97, 000 . 00) towards the initial purchase and that upon delivery, Greencastle Township will provide for the remainder of funds then due by either direct cash payment or by loan or lease, secured by said fire truck such being the obligation of Greencastle Township . The parties further agree that the balance thereon will be paid by the Greencastle Township over no longer than a three (3) year period. 4 . Engine #2 will be housed in the Greencastle City Fire Department and the Greencastle City shall be responsible for providing maintenance, insurance and the manpower to operate the equipment . So long as the fire truck is subject to a lien or claim by reason of outstanding purchase debt the equipment shall remain owned jointly by the City and Township. 5 . Administration of this agreement shall be by a two (2) person board, consisting of the Trustee or if he/she is unwilling or unable to serve then by a person specifically designated by the Township Advisory Board and the Mayor of the City of Greencastle, if he/she is unable or unwilling to serve a person designated by the City Council . 6 . The Township by terms of this agreement shall be authorized to incumber the equipment to the extent required for financing during the term of the loan. The parties further agree that upon payment of the debt by reason of the purchase that the Township will relinquish title to the City of Greencastle and this agreement shall terminate . 411 7 . Upon approval by the fiscal bodies of both the City of Greencastle and Greencastle Township this agreement shall be recorded with the County Recorder and filed with the State Board of Accounts for audit purposes .
