RESOLUTION NO. 03 -4170
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY RESCINDING RESOLUTION NO. 97 -3569 AND ELIMINATING THE
TENNIS COURT AND BASKETBALL COURT LIGHTING FEES FOR LIVE
OAK PARK
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
WHEREAS, pursuant to Section 3591 of the Municipal Code, the City Council has the authority to
establish fees for non - scheduled utilization of park facilities and utility use; and
WHEREAS, on February 18, 1997, the City Council adopted Resolution No. 97 -3569 establishing the
tennis court and basketball court lighting fees for Live Oak Park as follows:
1. Tennis court lighting fee - $.50 per thirty (30) minutes
2. Basketball court lighting fee - $.25 per thirty (30) minutes for one -half court lighting and
$.50 per thirty (30) minutes for full -court lighting; and
WHEREAS, the amount collected from the courts is minimal and does not recover costs associated
with pubic utilization of the facilities; and
WHEREAS, due to vandalism and other damage to the coin meters the City is no longer able to
cover maintenance costs with the established fees; and
WHEREAS, the Parks and Recreation Commission, at a regularly noticed meeting on March 19,
2003 recommended the City Council eliminate the fees for the use of the tennis court and basketball court
lights;
NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve, determine and
order as follows:
SECTION 1. Resolution No. 97 -3569 establishing the tennis court and basketball court lighting fees
for Live Oak Park is hereby rescinded.
SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution.
