HomeMy Public PortalAbout1974 ARESOLUTION OF AGREEMENT BETWEEN THE HENNEPIN COUNTY PARK RESERVE DISTRICT AND CITY OF MEDINA REGARDING MORRIS T. BAKER PARK RESERVE WHEREAS, the Hennepin County Park Reserve District desires to complete the acquisition of the property within the official designated boundaries of Morris T. Baker Park Reserve, especially those properties with unique recreational, conservation and Lake- shore value, and WHEREAS, the owners of the Medina Golf Course desire to sell their property to the Park Reserve District, and the District desires to make this purchase, and WHEREAS, the "1964 resolution of consent" made by the Medina Village Council pursuant to Minnesota Statutes 30,t09 (b) specifically excludes the Medina Golf Course from the District's authority to acquire, and WHEREAS, there are certain privately -owned properties within the Baker Park Reserve boundaries or encompassed by the 1964 resolution in the vicinity of U. S. Highway No. 12 and County Road No. 29 which are zoned industrial and which the Medina City Council believes should remain taxable and privately -owned in order to facilitate orderly development of the city, and WHEREAS, the Hennepin County Board of Commissioners has agreed to assume the responsibility for maintenance on the "park accefs" roads as hereafter describediHomestead Trail from CQmnty Road 6 to County Road 24, Parkview Drive from County Road 24 to. Hamel Road, and Hamel Roa4 .t'roM County toad 19 to Parkview Prive providing the Medina Village Council agrees to grant cbnadnt fbr the acquisition of Medina Golf Course by the Hennepin County Park Reserve District, NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners .of the Hennepin County Park Reserve District (hereafter referred to as the "District") and the Medina City Council (hereafter referred to ns "Medina") do hereby voluntarily enter into this agreement with n3spect to Morris T. Baker Park Reserve; BE IT FURTHER RESOLVED that Medina does hereby grant to the District consent to acquire Medina Golf Course; BE IT FURTHER RESOLVED that the District hereby amends tthe boundaries of Morris T. Baker Park Reserve to im s amele thisAlmaiimpoSatmENWFWAPaatWexclude certain properties in the vicinity of Highway 12 and County Road 29 as shown on the attached map which is made a part hereof; Resolution of Agreement Page Two BE IT FURTHER RESOLVED that Medina shall 1pe.apelmpielosel to submit a copy of its proposed zoning and development control ordinances for the area removed from the Baker Park Reserve boundaries and shall allow the District sufficient time to evaluate and comment upon said ordinances; BE IT FURTHER RESOLVED that Medina recognizes that it is beneficial and desirable for land removed from the Baker Park Reserve boundaries to be developed in accordance with desirable planning principles and in a manner compatible with neighboring park property; and that examples of such planning principles would include, for example, a prohibition on high-rise construction, buildings not higher than'21/2, floors, low noise levels, absence of obnoxious odors and signs, appropriate screening, and a procedure for submission of proposed development plans to the District for evaluation and comment prior to approval action by Medina; ,-- ' � spBE IT FURTHER RESOLVED that the District restates its policy with ree to owner -occupied residential parcels located in Medina ofacres or less located within Baker Park Reserve pJ.`r boundaries and that is ric wi see o buy such properA ties. at a time when an owner wishes to sell except as such parcel or parcels may be shown to the Medina Council as necessary to be acquired to facilitate the development of a park improvementL.;` t,,,6tAkh BE IT FURTHER RESOLVED that this agreement and resolutio shall become effective when approved by both the District and Medina within a period of 30 days.
