HomeMy Public PortalAbout19-1996-23 RESOLUTION NO. 1996-23 A RESOLUTION ESTABLISHING COVENANTS, CONDITIONS AND RESTRICTIONS OVER SERGEANT CUNNINGHAM TRACT WHEREAS, the City of Greencastle desires to establish standards and conditions concerning the development of industrial and commercial areas; and WHEREAS, the City presently holds title to a tract known as the Sergeant Cunningham site, the description of which is attached hereto as Exhibit "B"; and WHEREAS, the City has defined a specific set of covenants, conditions and restrictions as to the overall development of such site which covenants and conditions are attached hereto as Exhibit "A". NOW THEREFORE BE IT RESOLVED THAT THE CITY OF GREENCASTLE adopt the foregoing described covenants, conditions and restrictions as to the further development of the land commonly known as the Sergeant Cunningham site. BE IT FURTHER RESOLVED that such covenants, conditions and restrictions be recorded in the office of the Putnam County Recorder to run with the land herein described. Jones, Clerk-Tie surer SERGEANT CUNNINGHAM LEGAL DESCRIPTION Situate in the State of Indiana, County of Putnam and being a part of the South half of Section 13, Township 14 North, Range 4 West of the Second Principal Meridian, more particularly described to-wit : Commencing at the point of intersection of the centerline of a county road and the North right-of-way line of Indiana State Road #240 which point is 259 . 98 feet South and 3344 . 35 feet East of the Southwest corner of Section 13 , Township 14 North, Range 4 West; thence North 00 degrees 27 minutes 02 seconds West 2124 . 75 feet with the centerline of said county road; thence West 43 . 50 feet to the Southwest corner of a 0 . 694 of an acre tract of land deeded to Putnam County, Indiana as described in a deed, recorded in Deed Record 183 , page 530 in the Office of the Recorder of Putnam County, Indiana to the true point of beginning of the real estate herein described; thence from said true point of beginning, West 1306 . 50 feet with the North line of a 43 . 57 acre tract of land as described in a deed, recorded in Deed Record 183 , page 522 in the aforesaid Recorder' s Office; thence North 743 . 91 feet to the South line of real estate conveyed to International Business Machines Corporation as described in a deed, recorded in Deed Record 176 , page 601 in the aforesaid Recorder' s Office; thence North 63 degrees 15 minutes 10 seconds East 22 .40 feet with said South line to the North line of theSouth half of the aforesaid Section 13 ; thence South 87 degrees 24 minutes 03 seconds East 1282 . 34 feet e with said North line to the West line of the aforesaid tract of land deeded to Putnam County, Indiana; thence leaving said North line South 00 degrees 27 minutes 02 seconds East 696 . 87 feet with the West line of said tract of land to the point of beginning. !"1 EXHIBIT "B" 1
