CITY OF TIFFIN ORDINANCE NO. 2020-473
AN ORDINANCE TO VACATE A PORTION OF CITY RIGHT-OF-
WAY IN TIFFIN, IOWA
BE IT ENACTED by the City Council of the City of Tiffin, Iowa:
Section I. Purpose: The purpose of this ordinance is to vacate a portion
of City Right-of-Way on Ireland Avenue as shown on the attached plat. Such
vacation has been approved by the Planning & Zoning Commission at its
February 12, 2020 meeting.
Section II. Findings: The City Council of Tiffin, Iowa, hereby makes the
following findings:
A. That the City of Tiffin held a public hearing on the following proposal:
1. The vacation of a portion of the City Right-of-Way on the East
side of Ireland Avenue directly adjacent to the Tiffin Industrial
Park.
B. The right of way described above is not needed for the use of the
public, and therefore, its maintenance at public expense is no longer justified.
C. The proposed vacation will not deny owners of property abutting it
reasonable access to their property.
Section III. Repealer. All ordinances or parts of ordinance in conflict with
the provisions of this Ordinance are hereby repealed.
Section IV. Severability Clause. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication
shall not affect the validity of the ordinance as a whole or any section,
provision or part thereof not adjudged invalid or unconstitutional.
Section V. When Effective. This ordinance shall be in effect after its final
passage, approval, and posting as provided by law.
On the 5th day of May 2020, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Olney introduced Ordinance No. 2020-473, and
moved that it be given its first reading. The motion was seconded by
Councilperson Havens.
Ayes: Olney, Bartels, Schnedler, Walls, Havens
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No. 2020-473, was read the
first time, discussed, and placed on record.

On the 19th day of May 2020, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Bartels introduced Ordinance No. 2020-473, and
moved that it be given its second reading. The motion was seconded by
Councilperson Olney.
Ayes: Bartels, Schnedler, Walls, Havens, Olney
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No. 2020-473, was read the
second time and discussed and placed on record.
On the 2nd day of June 2020, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Havens introduced Ordinance No. 2020-473, and
moved that it be given its third and last reading. The motion was seconded by
Councilperson Bartels.
Ayes: Bartels, Schnedler, Havens, Olney
Nays: None
Four members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and the ordinance was passed and
adopted.
Whereupon the Mayor declared that Ordinance No. 2020-473 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the
Council on the 2nd day of June 2020 and approved by the Mayor on the 3rd day
of June 2020.

entitled AN ORDINANCE TO VACATE A PORTION OF CITY RIGHT-OF-WAY IN
TIFFIN, IOWA and known as No. 2020-473 was duly passed by the Council on
the 2nd day of June 2020, and signed by the Mayor on the 3rd day of June 2020,
and published on the 3rd day of June 2020, by posting copies thereof in three
