HomeMy Public PortalAbout1974-011'Y RESOLUTION, NO. 74-11, CONCERNING LIQUOR LICENSES OF GILBERT PETTIT WHEREA6 Gilbert Pettit is the holder of on -sale, off -sale and Sunday liquor licenses for the 55 Club in the City of Medina; and ,,,4+1WHEREAS agents of the Metropolitan Area Narcotics Squad (MANS) con- �; _ducted an investigation_ of the 55 Club in February 19�4; and WHEREAS the Medina City Council conducted a formal public hearing to �.' determine what action should be taken in regard to Mr. Pettit's liquor licenses, details of which hearing are on record with the city; (� NOW, THEREFORE, BE IT RESOLVED that the Medina City Council does 1 hereby make the following findings: 1� /( That certain violations of law, including use, possession and of marijuana took place at the 55 Club in February 1974; That the licensee, Gilbert Pettit, did in these violations; goikwoeiciehdicb That there 55 Club smoked marijuana while on duty; sale notIMOMM001 participate that one employee of the That, because of the open display, widespread use and distinctive smell of marijuana, Mr. Pettit knew or should have known that it was being used in his establishment; That Mr. Pettit could not have prevented two individuals from arrantging a sale of marijuana, but by allowing open display and use of marijuana he fostered conditions that would permit a sale; That Mr. Pettit is legally responsible for the conduct of and conditions in his place of business, for the conduct of his employees and for operating his business in a manner consistent with the public health, welfare and safety; That Mr. Pettit failed to keep proper order in his establishment and failed to keep it free of disorderly persons, and that activities related to drug use at the 55 Club are not Inemiliimunia consistent with the public health, welfare and safety.
