HomeMy Public PortalAbout15 - 2022-15 - AMENDING THE PLANNING AND ZONING ORDINANCE BY AMENDING THE ZONING MAP ORDINANCE .2022- 15 AN ORDINANCE AMENDING THE GREENCASTLE PLANNING AND ZONING ORDINANCE BY AMENDING THE ZONING MAP Petitioner: C&R Quality Rentals, LLC WHEREAS, the Plan Commission of the City of Greencastle has prepared this Ordinance to amend the Greencastle Planning and Zoning Ordinance by amending the zoning map; and WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this ordinance on September 26, 2022, after timely notice of the hearing was given by publication in the Banner-Graphic, Greencastle,Indiana on or before September 16,2022; WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the following factors enumerated in I.C. 36-7-4-603 in consideration of the ordinance and determination of a recommendation to be made to the Common Council: 1. the Comprehensive Plan; 2. current conditions and the character of current structures and uses in each district; 3. the most desirable use for which the land in each district is adapted; 4. the conservation of property values throughout the jurisdiction;and 5. responsible growth and development;and WHEREAS, the Greencastle Plan Commission has certified this Ordinance to the Common Council with a recommendation by a majority vote in favor of adoption; and WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan Commission and has paid reasonable regard to the factors enumerated in I.C. 36-7-4-603 before acting on this Ordinance;and WHEREAS,the Common Council has determined that this Ordinance should be adopted without amendment as certified by the Greencastle Plan Commission. NOW THEREFORE be it ordained and adopted by the Common Council of the City of Greencastle, Indiana,that: The City of Greencastle Zoning Map of the City of Greencastle Code, is hereby amended by changing the zoning classification for the following described real estate from PB to XD in accordance with I.C. 36-7-4-614: The property at northwest corner of Tennessee Street at the intersection with Veterans Highway, commonly known as 0 Tennessee Street, Greencastle Indiana, and more particularly described in the attached legal description. This ordinance shall have full force and effect upon passage. The Clerk-Treasurer of the City of Greencastle shall have this Ordinance published by inserting a copy of the Ordinance in each of the two (2)sets of the City of Greencastle Code maintained on file for public inspection in the office of the Clerk- Treasurer. Property to the east of this property was rezoned to XD District in 2012 which led to the development of Zinc Mill Apartments Phase I. Zinc Mill Apartments Phase II was approved south of Phase I in 2018. The property has vehicle access toward Veterans Memorial Highway/SR 240 as well as Zinc Mill Road. It also has pedestrian access to the People Pathways system with access to Ivy Tech and Greencastle High School. Tennessee Street is on the City's improvement plan which will make further improvements for traffic movement. Although the enclosed site plan is not a construction document, it illustrates how the property could be used for duplex development. Other properties with duplexes zoned XD District include Asbury Tower duplexes, Longcastle (Asbury Knoll Sub.) duplexes and Autumn Glen Village. Greencastle Rezoning Criteria is listed under Section 12.6 in the zoning ordinance. 1)The request is consistent with the City of Greencastle Comprehensive Plan. e the comprehensive plan recommends housing placement close to resources such as schools and recreational resources in existing neighborhoods (Residential Land Use Objectives Summary p. 42) and at all levels of income (Objective 4 Land Use); 2)The request is consistent with the current conditions and the character of structures and uses in each zoning district. ® the character of the area has changed from single family to multi-family. Professional Business development has never taken place. 3)The request is consistent with the most desirable use for which the land in each district is adapted. a it is desirable to provide appropriate development on vacant land. 4)The request is consistent with the conservation of property values throughout the jurisdiction. a construction of duplexes would increase the value of the property in a manner consistent with area property uses. 5)The request is consistent with responsible growth and development. ® the city has plans to improve Tennessee Street Use. The Greencastle Technical Review Committee met on Sept. 8 to get utilities and other departments input. The committee recommended approval. The Greencastle Advisory Plan Commission met on Monday, September 26 in public hearing to review the petition.
