RESOLUTION NO. 74-- , CONCERNING THE ELL CREEK PROTECTION AND
MANAGEMENT COMMISSION
WHEREAS the City of Yedina is partially within the Elm Creek
drainage basin and experiences common water management, soil,
sedimentation, and land use management problems with other munici-
palities within the basin;
WHEREAS state law authorizes municipalities jointly or coopera-
tively to exercise their common powers in addressing such problems;
and
WHEREAS the members of the Elm Creek Protection and Management
Commission have amended their joint agreement and enacted bylaws
to protect the rights of participants; and
WHEREAS it is in the best interests of the City of Medina to
develop solutions to the aforementioned problems jointly and co-
operatively with adjacent or nearby municipalities without estab-
lishing a new, overlapping or special-purpose taxing district;
NOW, THEREFORE, BE IT RES0LVED that the Medina City Council
approves the Joint Agreement to Protect and Manage the Elm Creek
Natural Itsource Area, Hennepin County, Minnesota (as amended.,
1974) anuthsorizes the Mayor and City Clerk to sign the agree-
ment on behalr of the City; and
BE IT FURTHER RESOLVED that the Medina City Council appoints
George Wyse as the City's representative to the Elm Creek Protec-
tion and Management Commission.
