RESOLUTION NO. 2001-_9.B
A RESOLUTION TRANSFERRING SURPLUS PROPERTY
WHEREAS, the City of Greencastle has surplus property, specifically loose equipment
(Self Contained Breathing Apparatus, hose, etc.) which is currently contained on the 1976 Ward
La France (E-1) fire truck and which is no longer needed or used by the Greencastle Fire
Department;
WHEREAS, the City of Greencastle desires to transfer ownership of the equipment to the
Van Bibber Lake Fire Department; and
WHEREAS, said transfer is being made pursuant to Indiana Code §36-1-11-8.
NOW THEREFORE BE IT RESOLVED THAT THE CITY OF GREENCASTLE hereby
transfers ownership of the above described loose equipment to the Van Bibber Lake Fire
Department for the consideration of $1.00. Said transfer shall take place upon passage of a
comparable resolution by the Van Bibber Lake Fire Department.
Further, the City of Greencastle makes no warranty whatsoever regarding the loose
equipment, and the Van Bibber Lake Fire Department takes ownership of said loose equipment
"as is" and shall hold the City harmless for any liability arising from this transfer of property.
PASSED AND ESOLVED by the Common Council of the City of Greencastle at its
regular meeting this ((�' tday of April, 2001.
