HomeMy Public PortalAboutResolution 03-42141 1 RESOLUTION NO. 03 -4214 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING ITS INTENT TO CONDUCT A PUBLIC HEARING ON WHETHER CONDITONS PRESENT AT 10217 LOWER AZUSA ROAD CONSTITUTE A PUBLIC NUISANCE WHEREAS, inspections of the single family residence located at 10217 Lower Azusa Road, Temple City, California, further described as Los Angeles County Assessor's Parcel Number 8585 - 015 -017, and having a legal description of Southeasterly 78.50 feet of Lot 1, in Block B of Tract No. 10992, as per map book recorded in book 193, page 1 of parcel maps in Los Angeles County, in the office of the County Recorder of said county, were conducted on not less than five separate occasions between March 2002 and October 2003; and WHEREAS, said observations indicate the following conditions are present at the site contrary to the provisions of Section 4230 of the Temple City Municipal Code: • Several inoperable vehicles in the front and side yard area. • A residential two -car garage converted into living space. • Junk, trash and debris in the front and side yard area. • Deteriorated landscaping in the front yard area. WHEREAS, such property and its condition may be hazardous, unsafe, unsightly, unsanitary and constitute a nuisance detrimental to the public health, safety and welfare and the property of others; and WHEREAS, Section 4233 of the Temple City Municipal Code provides a process for the City Council to conduct a public hearing to determine whether such conditions constitute a*public nuisance, the abatement of which is appropriate under the powers and authority of the City of Temple City; and WHEREAS, such abatement may be accomplished by the appropriate removal of unpermitted alterations and additions made to the garage, the removal of all junk, trash and debris from the front yard, reseed or re -sod the front yard area, and the placement of said inoperable vehicles within an enclosed garage or by removing them from the premises. NOW, THEREFORE, the City Council of the City of Temple City hereby resolves and directs as follows: SECTION 1. The City Manager is hereby authorized to commence the process outlined in Section 4233 to set the date for a public hearing and to take other actions there under. SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution. PASSED, APPROVED, AND ADOPTED on this 21st day of October, 2003.
