RESOLUTION NO. 03 -4216
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY CONFIRMING AND EXPANDING THE EXISTING UNDERGROUND
UTILITY DISTRICT NO. 4
WHEREAS, in accordance with Section 6300 et seq. of the City of Temple City Municipal Code
notice of a public hearing to determine whether the public necessity, health, safety, and welfare requires the
removal and undergrounding of poles, wires, and associated overhead utility structures and facilities for the
supply and distribution of electric, communication and related services within the proposed expanded
Underground Utility District No. 4 has been provided in accordance with law; and,
WHEREAS, all affected property owners were notified in the manner required by law of the intention
of the City to establish the District, and the City Council conducted duly noticed public hearings on December
4, 1979 and December 2, 1980, regarding the formation of the District and on November 4, 2003, regarding
the proposed expansion of the District; and,
WHEREAS, the location of the District is more fully described on the maps and legal descriptions on
file with the City Clerk; and,
WHEREAS, the City Council hereby finds and determines the undergrounding to be accomplished
with the proposed expanded District will avoid and eliminate an unusually heavy concentration of overhead
distribution and transmission facilities and that the street, roads, and rights -of -way in said District are
extensively used by the general public and carry a heavy volume of vehicular traffic; and,
WHEREAS, the City Council has determined that it is necessary and appropriate for the
improvement of the District to be expanded at the earliest possible date.
NOW, THEREFORE, the City Council of the City of Temple City hereby resolves, determines, and
orders as follows:
SECTION 1. Underground Utility District #4 is hereby reaffirmed; and,
SECTION 2. The public necessity, health, safety, and welfare warrant the expansion of said District:
1) to facilitate the removal of poles, overhead wires, and associated structures, and the underground
installation of wires and utilities for supplying electric, communication and similar or associated
services on such public streets, rights -of -way and private properties as are described and shown on
the maps on file with the City Clerk, which are incorporated herein by this reference; and 2) for
conversion (connection) of customer meter panels; and,
SECTION 3. All poles, overhead wires, and associated overhead structures are hereby ordered to
be removed and underground installation and customer conversions shall be made no later than
forty -two (42) months from and after the date of adoption of this Resolution upon all properties in the
area of the expanded District as generally located fifty feet (50') east and west of centerline on
Encinita Avenue, between two hundred feet (200') north of Las Tunas Drive and thirty feet (30') north
of the Eaton Wash, as described more fully on the maps on file with the City Clerk and made a part
hereof; and,
SECTION 4. The construction contemplated within the District is categorically exempt in accordance
with Section 15302(d) of the State Guidelines for the implementation of the California Environmental
Quality Act of 1970, as amended; and,

SECTION 5. Pursuant to Government Code Section 65402(b), the District includes utility
improvements of a minor nature and therefore, the provisions of Government Code Section 65402
requiring submission to and report upon said project by the City Planning Commission are
inapplicable to the District. The City Clerk shall submit a Notice of Exemption with respect to the
District for filing with the Clerk of the County of Los Angeles in the manner required by law.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution.
