IF the date of the letter from EPD precedes our becoming the issuing authority&our adoption of the revised ordinance( it does) , I think the same opinion I gave as to Bernie Goode does apply. That is, his approval was before the city ordinance& his letter from EPD stands. Actually, his is clearer to me than was Mr Goodes, as there has been no change of plans as occurred with that one. EPD has determined that the proposed activity would be considered a minor land disturbance and therefore a variance will not be required. Please note the following conditions: 1). The pouring of concrete pads within the buffer would not be permissible. 2). A Notice of Intent for coverage under the State's General Permit GAR 100003 for the discharge of stormwater from a construction activity must be submitted to the local EPD district office at least fourteen (14)days prior to the start of construction activity if the total estimated land disturbance exceeds one (1) acre. 3). Best management practices (i.e.; silt fencing and/or other erosion control measures)must be implemented upon the start of the project and maintained for the project's duration in order to minimize impacts on the buffer and the adjoining marsh. 4). A pile driver, if used, should be maintained outside of the buffer as much as feasible. 5). There shall be no grading in the buffer. 6). Any gutters installed should drain outside of the buffer. 7). EPD suggests you mark the 25ft buffer to ensure awareness of its location during construction. 8). All of the undisturbed buffer should remain in its existing state until after construction activity has ceased and all disturbed areas have been properly stabilized. 9). EPD strongly encourages maximum use of permeable surfaces wherever possible, i.e. driveways.
