A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF TRUCKEE
APPOINTING SPECIAL COUNSEL
WHEREAS, the Town of Truckee was incorporated on March 23, 1993, as a
general law city of the State of California; and
WHEREAS, it is necessary for the efficient operation of the affairs of the Town that
the Town Council engage an attorney to provide legal advice on specific matters
concerning the Town;
NOW, THEREFORE, the Town Council of the Town of Truckee does resolve as
follows:
Section 1. The law firm of Porter, Simon, Graham, Phelps and Cuttitta is hereby
engaged as special counsel, with John M. Phelps serving as primary special counsel.
Section 2. The special counsel shall receive as compensation for legal services
rendered the sum of $125 per hour, and shall be reimbursed necessary expenses as set
forth in a contract to be executed between the Town and the special counsel subsequent
to the date hereof.
Section 3. The firm of Porter, Simon, Graham, Phelps and Cuttitta shall be
engaged as special counsel pursuant to Government Code Sections 37103 and 5,3060
to provide legal advice on specific matters which the Town Council asks the firm to render
advice on and the firm agrees to render advice on. The firm of Porter, Simon, Graham,
Phelps and Cuttitta shall not serve as, and shall not have the responsibilities of, city
attorney, as that term is used in Government Code Sections 41801 - 41804.
Section 4. The firm of Porter, Simon, Graham, Phelps and Cuttitta shall serve as
special counsel on only a short-term interim basis, until the Town has engaged an interim
city attorney, or a permanent city attorney. The Town Council acknowledges that the firm
of Porter, Simon, Graham, Phelps and Cuttitta has encouraged the Town Council to select
alternate counsel as soon as possible.
PASSED, APPROVED AND ADOPTED this 23rd day of March, 1993, by the
following vote:
