a nereas ichael Scherer has applied for a variance from Section
5 of the medina elatting Code in order to purcnase 5 acres of
land -locked property from nis fatner, meinrod ocherer, for the
purpose of building a home, and
ahereas to construct a new road to thisproperty at this time when
the future street pattern and access road to roly Dame Lake Ls.tates
is unknown would be an unnecessary hardsnip, and
whereas the Medina City Planning Commission, at their meeting
April 8, 1975, has recommended granting the subject variance,
subject to filing a legal description of an access easement for
the land locked parcel with the city and with the county when the
deed is filed,, and
Whereas Michael Scherer has now secured from Mein.rod Scherer an
easement across his property on the existing driveway as requested
by the Planning Commission, and has also filed tnese documents
with the nenn.. Co. Register of Deeds, and provided copies to the
City, as required by the Planning Commission as a condition for
approval,.
Aow, therefore, be it resolved that the Medina City Council does
hereby grant to laichael Scherer a variance from the elatting Code
as requested on condition tnat the deed for the easement not be
seperated from the deed for the 5 acre nomesite unless an alter-
native access is provided.
