HomeMy Public PortalAboutResolution 03-42231 1 RESOLUTION NO. 03 -4223 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING ITS INTENT TO CONDUCT A PUBLIC HEARING ON WHETHER CONDITONS PRESENT AT 5736 RIO HONDO AVENUE CONSTITUTES A PUBLIC NUISANCE WHEREAS, inspections of the single family residence located at 5736 Rio Hondo Avenue, Temple City, California, further described as Los Angeles County Assessor's Parcel Number 8587 - 004 -014, and having a legal description of the west 140 feet of the South half of Lot 759, of Tract No. 6561, as per map recorded in book 72, pages 34 and 35 of parcel maps in Los Angeles County, in the office of the County Recorder of said county, were conducted on not less than twenty -two separate occasions between November 1999 and October 2003; and WHEREAS, said observations indicate the following conditions are present at the site contrary to the provisions of Section 4230 of the Temple City Municipal Code: • Overgrown weeds, grass, and miscellaneous vegetation in the front yard, north and south side yards and rear yard area. • Several overgrown trees in the front, side and rear yard areas. • Junk, trash and debris being stored in the front and side yard areas. • A single - family dwelling and garage having faulty weather protection on the exterior walls and roof areas. • The storage of garbage cans in the front yard area. • An inoperable Mazda pickup truck on the open driveway area of the site; and WHEREAS, such property and its condition may be hazardous, unsafe, unsightly, unsanitary and constitute a nuisance detrimental to the public health, safety and welfare and the property of others; and WHEREAS, Section 4233 of the Temple City Municipal Code provides a process for the City Council to conduct a public hearing to determine whether such conditions constitute a public nuisance, the abatement of which is appropriate under the powers and authority of the City of Temple City; and WHEREAS, such abatement may be accomplished by the appropriate cutting of all overgrown vegetation on site, and the appropriate cutting, trimming, or pruning of all overgrown trees on site, removal of all junk, trash and debris from the site, removal of garbage cans from the front yard, repainting the exterior walls and replacing the roof coverings of the garage and dwelling, and the placement of said inoperable vehicle within an enclosed garage or by removing it from the premises. NOW, THEREFORE, the City Council of the City of Temple City hereby resolves and directs as follows: SECTION 1. The City Manager is hereby authorized to commence the process outlined in Section 4233 to set the date for a public hearing and to take other actions thereunder. SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution.
