HomeMy Public PortalAbout1975-029CITY OF MEDINA RESOLUTION 75-29 Whereas Roger Schmidt has applied for a variance from Section 5b of the zoning code of the City of Medina which provides that only one main building may be located on one lot, and Whereas Roger Schmidt has filed plans with the City to construct a building on Lots 7 & 8, Block 2, Plat of Hamel, although Lot 7 already contains a small house converted to office space, known as the Scott building and so represented on the plans, and Whereas the Scott building is deemed to be a temporary building and will one day be removed, and Whereas Lots 7 & 8, Block 2, Plat of Hamel are small lots with only 50 feet of street frontage and do not meet the required minimum lot size required in Hamel, and Whereas Roger Schmidt has assertedthat it would be a hardship to develop each one of the lots individually and has stated his willingness to legally combine Lots 7 & 8 into one new lot, and Whereas any resubdivision of this new lot to separate the two buildings would again result in substandard irregular shaped lots, and Whereas Roger Schmidt has presented a site plan showing the necessary parking spaces for the new building plus a plan for handling parking for the apartment building on Lot 9, to the west, which was previously using Lot 8 as parking space, and Whereas the City Engineer has recommended that a bond in the amount of $1850.00 be posted with the City to assure completion of the parking lot on Lots 7 & 8, Now therefore, be it resolved that the Medina City Council does hereby grant a variance from Section 5b of the Zoning Code to Roger Schmidt to construct a building on Lots 7 & 8, block 2, Plat of Hamel, provided that: 1. No addition to Scott Realty building be permitted, 2. No rebuilding in case of catasrophe, 3. Building to be removed within 12 years, 4. Roger Schmidt file with the City Assessor a combination form to combine Lots 7&8, 5. No future resubdivision of the new lot be permitted to separate the two buildings, 6. A bond for $1850.00 be posted with the City to assure completion of the parking lot. Passed by the Council of the City of Medina this / day of 1975• Mayor
