ABSENT: Jamie Balliett, (Associate Member); and Jennifer Wood, Conservation Administrator. The Meeting opened at 8:30 a.m. CONTINUATIONS Preston & Birgitta Hay (GC1,J131), 289 South Orleans Road by Ryder & Wilcox, Inc. The Order is proposed to be amended for the driveway grade to remain raised with a culvert between the 2 wetlands, & for a shed to remain at 47' from an Isolated Wetland (instead of 51'). Work will occur within 100' of two freshwater wetlands and within the Pleasant Bay ACEC. David Lyttle, from Ryder & Wilcox, and Mr. and Mrs. Hay, the Applicants, were present. Mr. Lyttle said he submitted a'revised Plan showing a 12"-wide ADS pipe that will be installed under the driveway to allow a drainage connection between the wetlands. Steve Phillips asked if the pipe would be level? Mr. Lyttle said yes. George Christie asked how long this pipe was? Mr. Lyttle said it will be 60'-long. Mrs. Hay said she has prepared a Landscape Plan with a Planting List. Arnold Henson said the proposed Conditions on this Order are that any bare areas after 1 year be planted with grass plugs instead of seed; there is to be no mowing without approval; there are to be no seating areas or paths within the old house site; and Standard Planting Plan Conditions will be a part of this Order. Bob Royce asked if the invasive species would be removed? Mrs. Hay said they are pulling up the invasive English ivy as much as they can, and will continue to do so. Invasive species removal from disturbed areas will be a Condition on the Amended Order. MOTION: A motion to approve this project with the Site Plan revised April 23, 2009 with the Conditions noted above, was made by George Christie and seconded by Bill Parish. VOTE: Unanimous. Mark Kritzman (AH), 204 Barley Neck Road by Ryder & Wilcox, Inc. A proposed 3-Year Restoration Plan, to remove invasive plant species &to plant native species. Work will occur on & within 100' of a Coastal Bank, within 100' of a Salt Marsh & an Inland Wetland, & within Land Subject to Coastal Storm Flowage &the Pleasant Bay ACEC. Jay Pettit, from Uncommon Ground, said the new Landscaping Plan shows the northern granite path will be replaced with fieldstones, and will not extend further than the existing location. He relabeled the small stone wall.on the Site Plan to be a small stone jumble, not a wall. Mr. Pettit said the 3 cedars will be replaced with cedars, and the honeysuckle plus PAGE 2-MINUTES-WORK MEETING-TUESDAY, APRIL 28, 2009 the other invasives that border the marsh will be replaced with native roses and bayberry. James Trainor asked if the fieldstone wall will have mortar? Mr. Pettit said no, the stones will be set on the ground. George Christie asked if Mr. Pettit was doing the work by himself? Mr. Pettit said he will be doing the bulk of the work. Arnold Henson asked how large are the replacement cedars? Mr. Pettit said 5 to 6'. Judith Bruce said this is a wonderful Plan. MOTION: A motion to approve this project with the Landscaping Plan revised April 22, 2009, conditioned on the Baccharis maintained in a naturalized way at the height of 6'; the invasive shrubs removed from the beach being replaced with native shrubs; there will be no hardscape or walkway into the marsh; the loose stones at the bottom of the bank will not now or in the future be made into a retaining wall or revetment; and Standard Conditions for Planting Plans, was made by Judith Bruce and seconded by Bill Parish. VOTE: Unanimous. CERTIFICATES OF COMPLIANCE Rodney Shepard (1975), 1 Phoebes Close. These are 2 Certificate of Compliance requests for a proposed 3-bedroom and a 4-bedroom dwelling that were never built. No work went forward under these Orders. MOTION: A motion to release these 2 Certificates of Compliance where no work was done was made by George Christie and seconded by Bill Parish. VOTE: Unanimous. ADMINISTRATIVE REVIEWS Philip and Barbara Deschamps, 163 Tonset Road. This is a request to pump and fill an existing tank and leach pits in a driveway area within 100' to a freshwater wetland. The new system is outside the buffer in the driveway. The Site Plan does not show a fence and arbor attached to the main deck, a retaining wall from the steps to that deck, a concrete lip on the garage, gas tanks behind the garage, or a fence and compost bin next to the garage. This has been filed as an Administrative Review so that the Commission could request a more complete Plan with any other work in the buffer. This Site Plan was done by J.C. Ellis Design Co., Inc. George Christie requested that the Site Plan be brought up-to-date if there is more work within the buffer zone. MOTION: A motion to approve this Administrative Review was made by George Christie and seconded by Adrienne Pfluger. VOTE: Unanimous. Steven and Deborah Whittemore, 83 Finlay Road. This is a request to pump and fill existing cesspools in a fenced-in yard area within the 100'-foot buffer to a white cedar swamp. The new system is outside the buffer. This has been filed as an Administrative Review so that the Commission could request a more complete Plan with any other work in the buffer. This Site Plan was done by J.C. Ellis Design Co., Inc. George Christie requested a more up-to-date Site Plan if there is more work within the buffer zone. MOTION: A motion to approve this Administrative Review was made by George Christie and seconded by Bill Parish. VOTE: Unanimous. Snow Point Property Owners Association, Inc., Freeman Lane. This Administrative Review was originally heard April 7, 2009 and has been reduced from building steps to just filling in low areas of in-ground steps with mulch. MOTION: A motion to approve this Administrative Review was made by Bill Parish and seconded by Bob Royce. VOTE: Unanimous. Snow Point Property Owners Association, Inc., Freeman Lane. This Administrative Review was originally heard April 7, 2009 and has been reduced to cutting of shrubs growing into the roadway and mowing 2 paths as needed for safe passage. No vegetation will be removed on the beach. MOTION: A motion to approve this Administrative Review was made by Bill Parish and seconded by Judith Bruce. VOTE: Unanimous. Victor Verdina, 32 Tides End Lane. This is a request to remove one pine tree leaning toward the deck. A replacement tree will be planted. MOTION: A motion to approve this Administrative Review was made by George Christie and seconded by Bill Parish. VOTE: Unanimous. Jim West, 89 Briar Springs Road. This Applicant recently filed in March to plant a serviceberry. He would now like to plant an eastern redbud, 4 maple- leaved viburnums, and 3 river birch. There are inkberry now at the site of the river birch planting that will be transplanted up nearer the house. MOTION: A motion to approve this Administrative Review was made by Bill Parish and seconded by Judith Bruce. VOTE: Unanimous. PAGE 4-MINUTES-WORK MEETING-TUESDAY, APRIL 28, 2009 Susan Cochran, 111 Davis Road. This is a request for the proposed removal of bittersweet on the upper section of a coastal bank on the west side of the main dwelling. MOTION: A motion to approve this Administrative Review was made by Bill Parish and seconded by Bob Royce. VOTE: Unanimous. Diane Speara, 3 Captain's Row. This is a request for the proposed removal of 1 pitch pine that is failing, 7 black cherries that are fine, and 1 locust stump. The work is in the naturalized area that also provides screening that was required for the building of this dwelling. The Tree Warden should be asked for his approval as the pine tree is near the road. The cherry trees should remain unless a substantial Replacement Plan is offered so that the naturalized area and screening remain. Judith Bruce said she is not in favor of this request. George Christie said the Tree Warden should be contacted. MOTION: A motion to approve this Administrative Review was made by George Christie and seconded by Judith Bruce. VOTE: 0-7-0 Denied. Town of Orleans, Parks and Beaches Department. This is an annual request to remove sand from the Skaket Beach Parking Lot, the Skaket Beach Walkway, and from Skaket Beach Road, adjacent to the Parking Lot. MOTION: A motion to approve this Administrative Review was made by Bill Parish and seconded by Judith Bruce. VOTE: Unanimous. CHAIRMAN'S BUSINESS Approval of the Minutes from the HearingMork Meeting on April 21, 2009. MOTION: A motion to approve the Minutes from the Hearing/Work Meeting on April 21, 2009 was made by Bill Parish and seconded by Bob Royce. VOTE: 6-0-1 Approved (Arnold Henson abstained). The Site Visits were discussed by the Commissioners.
