RESOLUTION NO, 757-3di
RESOLUTION ORDERING THE RAZING AND REMOVAL OF
DILAPIDATED BUILDING ON THE NORTH 60 FEET OF
LOT 29, AUDITOR'S SUBDIVISION 241, HENNEPIN COUNTY,
MINNESOTA.
WHEREAS, James Michael Dorn is the record owner of property legally
described as the North 60 feet of Lot 29, Auditor's Subdivision 241, Hennepin
County, Minnesota, located in the City of Medina; and
WHEREAS, Russell Bouley, Jr., Building Inspector for the City of
Medina, inspected said property on August 27, 1975 and found the building
thereon, a two story house with basement, to be in a dilapidated and decrepit
condition in that the porch is falling away from the house, the foundation is
missing in several places leaving the house partially unsupported, and the house
is partially unenclosed and further, the house and yard is littered with manure
and rats were observed running throughout; and
WHEREAS, said Building Inspector formed the opinion on August 27, 1975 that
the said building was in a state of complete deterioration and dilapidation, was
completely irreparable and could not be brought up to building code standards:
NGW, THEREFORE, BE IT RESOLVED that James Michael Dorn, his
heirs and assigns, shall be ordered to raze and remove the dilapidated building
on the property legally described as the North 60 feet of Lot 29, Auditor's
Subdivsion 241, Hennepin County, Minnesota, said action being taken pursuant
to Minnesota Statutes § 463. 15 - 463.261 on the grounds that said building is a
hazardous building because of dilapidation, inadequate maintenance and physical
damage contituting a hazard to the public safety and health within the meaning of
Minnesota Statutes § 463, 15;
BE IT FURTHER RESOLVED that the said James Michael Dorn, his heirs
and assigns, must either comply with this order within twenty (20) days from the
date of service thereof upon him; or within twenty (20) days therefrom file an
answer thereto or a motion for summary enforcement of this order will be taken
by the City of Medina in the Hennepin County District Court.
