The findings are to be reported at the Regular Counc:t Meeting to be held May 27, 1975. Mr. Maley read a letter from the District Engineer, U.S. !army of Engineers, with reference to our application of a permit for an alternate borrow area nearer to shore. Based upon the position taken by the District Engineer, it was moved by Mr. Davis, seconded by Mr. Taplin, and unanimously voted that the application be withdrawn. Mr. Anderson stated he has filed a Petition for He- Hearing in the Florida Supreme Court, re: Giblin vs. Bal Harbour Village. It was requested that the Negular Meeting of the Bal Harbour. Village. Council, scheduled for 9:30 A.M., Tuesday May 27,19750 be postponed until 2:00 P.M. on that date, in order for Mr. von Oesen and Dr. Duane to be able tc attend. Request approved by Council. Mr. Maley advised that May 15, 1975 was the deadline for filing Public Officials' Financial Disclosure statements. There being no further business, it was moved by Mr. Davie,seconded by Mr. Taplin, and unanimously voted, that the meeting be adjourned at 12:15 P.M. ATTEST: Village Clerk May 15,1975 Mayor May 27, 1975 The Council of Bal Harbour Village met Tuesday May 270 1975 at 2:OOP.M. in the Village Hall. Present: Messrs. Davis, Printup and Taplin Absent: Messrs. Beatty and Logan Also present were Fred W. Maley, Village Manager; Mary T. Watterer, Village Clerk; Messrs. Thomas Anderson, Village Attorney and Karl Hart. On motion of Mr. Davis, seconded by Mr. Taplin and voted, the minutes of the previous meetings of April 29th, May 5th and May 15th, 1975 were approved as submitted. Mrs. Connie Morrow reported on the action taken by various municipali- ties comprising the local Commission on the Status of Women. Mrs.Morrow said there were some points to be clarified in the proposed resolution setting up the ��A Commission. Mayor Printup said he was going to meet with Mayor Portman and Mayor Haas before the next meeting to discuss the matter. Mayor Printup said that due to the pending assessment by the Bal Harbour Club on the residential owners, he would be in favor of delaying the proposed storm sewer construction and street work, but thought that the Village should consider the residential street lighting project. It was moved by Mr. Davis, seconded by Mayor Printup that the matter be tabled until the next meeting. The motion passed with Messrs. Davis and Printup voting "yea "; Mr. Taplin "no ". Mr. Maley said he had studied proposals received from three firms on a traffic study at the Shopping Center area and recommended Wilbur Smith and Associates due to their concept of what should be considered. After discussion on motion of Mr. Taplin, seconded by Mr. Davis it was unanimously voted to retain Wilbur Smith and Associates for a fee not to exceed $5,500.00. Mr. Anderson told the Council that he had filed a Petition for Rehearing with the Supreme Court of Florida in the Giblin case and has challenged the right of the Court to hear this case due to the present makeup of the Court. On motion of Mr. Davis, seconded by Mr. Taplin and voted the Americana Hotel was given permission to use the garage space for convention display purposes through December 1975. Mr. Maley reported that Bankers Life Insurance Company has requested a 39.7% raise in our health insurance premiums for the new year which would being on July let. It was the Council's decision that we would contact the Equitable Life Assurance Society, our previous carrier, and ask them to submit a bid for the group insurance. Mr. David Duane of NEED, Inc. and Mr. Richard Benson of Technos, Inc. discussed with Council, Mr. von Oesen and Mr. Whittaker, the findings of their survey of the dredging borrow area and surrounding ocean bottom in relation to the report submitted by Dr. Brooks for Great lakes Dredge and Dock Company. It was pointed out that our engineers for the project had offered assistance to Great Lakes in locating the borrow area, which had been declined. It was the eoncensus of opinion that photographs of the area should be obtained and also that the Village should purchase the Side Scan prints. It w%s moved by Mr.Taplin seconded by Mr. Davis and unanimously voted that the Village purchase the Side Scan Sonar prints for $3000, and expend up to $10,000. for further exploration, as determined by our engineers, attorney, and approved by the Village Manager. Underwater pictures are to be taken in the vicinity of Dr. Brooks' pictures. There being no further business on motion of Mr. Davis, seconded by Mr. Taplin and voted, the meeting was adjourned at 4:45 P.M. { Mayor ATTEST: Village Clerk May 27, 1975 May 29,1975 A Special Meeting of the Council was held Thursday, May 292 1975 at 3:45 P.M. in the Village Hall for the purpose of discussing the law suit regarding lot 11 of the Ocean Front District. Present: Messrs. Beatty, Davis, Logan, Printup and Taplin Alm present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; Mr. Thomas Anderson, Village Attorney; William Simmons; and Mr. R. Patterson, Building Inspector. The Council and Village Attorneys discussed with Mr. Joseph Jacobs and Robert Angerer of the firm of Erwin, Vern, Jacobs and Odom of Tallahassee, the status of the litagation and possible alternatives depending on the ruling of the Florida Supreme Court. Mr. Simmons suggested to the Council that Mr. Jacobs' firm should handle all new matters in the case and Shutts and Bowen will cooperate from here. In regard to the matter of fees, Mr. Jacobs said that their costs would be $100.00 per hour for his time and $50.00 for an associate, until we reach a decision. If further litigation is decided upon then the fee will be on a different basis. There being no further business on notion of Mr. Beatty, seconded by Mr. Taplin, the meeting was adjourned at 4:45 P.M.
