The electrical and the HVAC equipment are elevated above the Base Flood Elevation within their respective ground floor enclosures. You are correct about the possibility of an unenclosed area becoming enclosed. I will be mindful of that rather than just how big the existing enclosure may be. You are also correct that Chatham County and the City of Savannah require Nonconversion Agreements in Special Flood Hazard Areas. Let me know if I'm not explaining this well enough. Dianne K. I only have a vague recollection of this but that is not unusual these days. I am not sure I understand your last paragraph below. Are the rooms with the electrical equipment below base flood? I assume not.& the same for the closet with the HVAC. I still have no problem on insisting on the form as I think it is a good idea when the flood zone is triggered-but I do not mean all flood zones. I think a problem may be unenclosed areas becoming enclosed & made habitable in the future so it is sort of hard to predict just based on what is currently in place. I will contact Mark Shawe & tell him the form is relatively new but that the e3quivlaent is being used by Chatham county & Savannah & I think they all began about the same time with the last overhaul of the flood control ordinances, but do let me know about the elevation issues. The discussion of Tybee Island requiring a Nonconversion Agreement dates back to 2008. Attached are a couple of emails from then. I have notes from a discussion that you and I (and Brannyn?) had about the version of the agreement that is attached to the email "Nonconversion Agreement." In August of 2009 I asked Tom McDonald for a copy of the City of Savannah's form which he provided the following day. My Word program says on 10/26/2009 I created the form that is now in use although it has been modified since that time. Jonathan was here then. I don't have an email that shows it was approved by anyone to begin using. I'm guessing that Jonathan gave me a verbal approval. To me, the form is now standard but it is not always applicable. Nine Certificates of Occupancy for residential new construction have been issued since 10/26/2009. There haven't been any substantial improvements. I've looked at several of the 9 files and Mr. Shawe may be correct that no Nonconversion Agreements have been recorded. The most recent C.O. was for 14 Tenth Place. That house was built to just meet the Base Flood Elevation plus 1-foot freeboard so there isn't an enclosure (or parking) under the house, thus a Nonconversion Agreement was not needed. For the remainder of 2011 there was Jimmy Brown, Judy Quinney, Bernie Goode, and Jerry Bunton. Each of those have a very small enclosed storage area with the rest of the area under the house being open parking. Bunton's does include an enclosed building access. His enclosure is 313 square feet total. There are 4 permits that received C.O.s between April and August of 2010. Since I do not recall when the Nonconversion Agreement was approved I didn't spend time determining if this requirement was 2 4. A FEMA inspection following receipt of the Elevation Certificates. Access to the ground floor enclosures will be needed. 5. Record Nonconversion Agreement for each unit. Attached is the form. The C.O.s will not be held for this. 6. Issue Certificates of Occupancy. Unless further descriptive and identifying information for said properties is added below, said properties or "Lots" are more fully set out on that certain recombination plat prepared by Vincent Helmly, RLS, and recorded in Plat Book 11.- P, page 14, in The Office of the Clerk of the Superior Court of Chatham County, Georgia, ("the Helmly Plat")to wit: 1. John C. Wylly, Jr. Lot D—1 (PIN 4- 0010— 05 —OO1D); said lot is further shown as modified Lot D-1-A on the Keaton Recombination Survey hereinafter described. Lot D-3 and Lot C-2 (Combined PIN 4—0010—05 —019). Lot D-2-2 (PIN 4-0010-05-018) as set forth on a plat or survey recorded in subdivision map book 34-S, Page 85 aforesaid records. Sa3rd Floor 1MTS\REALEST\WYLLY\Easement Agreement 7-25-11.docx Page 1 of 7 • WHEREAS, the aforesaid Helmly Plat shows and depicts thereon a 20 foot wide access easement (the "Access Easement") lying partly on or abutting the above properties, which Access Easement currently provides for vehicular and pedestrian ingress and egress from Chatham Avenue to lots D-2, D-3,C-2,D-2-1,D-2-2,and C-1 ; and WHEREAS, there is further shown and depicted on said plat or survey a 5 foot access easement (the "Walking Easement") extending from the Western terminus of the Access Easement across Lot D-3 to the Tybee Creek lying to the west of lot D-3; and WHEREAS, the undersigned property Owners, to the extent that their Lots may be benefited or burdened, wish to provide in this written recordable agreement their consent and agreement to certain modifications to such easements.: NOW THEREFORE, for and in consideration of the premises, and other good and valuable consideration flowing from each party to the other, the receipt and sufficiency of which are hereby acknowledged,the parties, intending to be legally bound, agree as follows: Modification of Access Easement. All parties agree that the Access Agreement shall hereafter be modified as to the location, dimensions, boundaries and configuration as are set forth on the Keaton Recombination Survey and the Keaton Subdivision Survey as said Access Easement crosses lots D-2-2-B, D-1-A and of the property of Tybee Ventures, LLC. The remaining portions of the Access Easement shown on the Helmly Plat not modified by the Keaton Surveys remains in effect. To the extent that the Access Easement has shifted onto or within one or more of the above referenced Lots, where it had not previously been located, (or any subdivision or recombination of such Lots), as a result of the Keaton Surveys the undersigned property Owner does hereby grant, declare, and encumber the portion of their lot lying within such Access Easement as shown on said Keaton Recombination Survey or Keaton Subdivision Survey for the purposes of such Access Easement heretofor existing, namely, for vehicular and pedestrian ingress and egress from Chatham Avenue to the aforesaid Lots. To the extent that the Access Easement has shifted away or been removed from certain portions of a Lot or Lots as a result of the Keaton Surveys, the undersigned property Owners do hereby quitclaim and release to the Owner of the Lot upon which such Access Easement formerly encumbered,that portion of such Lot, free and clear of the Access Easement. Modification/Termination of Walking Easement. The 5 foot pedestrian Walking Easement is hereby terminated as to the use or benefit Lots D-1-A, D-2-2-A, and D-2-2-B. No Dedication to the Public. Nothing contained in this Agreement shall be deemed to be a gift or dedication of any portion of any Lot to the general public or for any public use or purpose Page 2 of 7 S:13rd FlooAMfS\REALESTIWYLLY1Essement Agreement 7-25-11 do= whatsoever, it being the intention of the parties hereto that this Agreement is for the exclusive benefit of the Lot Owners and their successors, assigns, mortgagees, tenants, customers and invitees, and that nothing in this Agreement, express or implied, shall confer upon any person, other than such Lot owners, and their successors, assigns, mortgagees, tenants, and invitees any rights or remedies under or by reason of this Agreement. No Termination for Breach. It is expressly agreed that no breach, whether or not material, of the provisions of this Instrument shall entitle any Lot Owner to cancel, rescind or otherwise terminate this Agreement, but such limitation shall not affect, in any manner, any other rights or remedies which any Lot Owner may have hereunder by reason of any breach of the provisions of this Instrument. Modifications. The Owners of the Lots agree to modify the provisions of this Agreement to comply with a reasonable request to do so by any governmental or quasi-governmental authority with jurisdiction thereover; provided that the modification does not (a) increase the obligations, or (b) impair the rights and benefits of the party not requesting the modification. Miscellaneous. The easements, benefits and obligations created hereunder shall create mutual benefits and servitude running with the title to the land. The Owner of each Lot shall use and enjoy all easements created hereunder and benefiting said party in such a manner so as to not unreasonably interfere with the adjacent party's use, enjoyment and development of its respective Lot. This Agreement shall bind and inure to the benefit of the owners from time to time of each Lot and their respective legal representatives, successors, heirs, grantees and assigns. The headings herein are inserted only as a matter of convenience and for reference and in no way define, limit or describe the scope or intent of this Agreement, nor in any way affect the terms and provisions hereof. This Agreement shall not be modified or altered in any respect except by a writing executed by the Owners from time to time of all of the Lots. This Agreement shall be governed by and construed and interpreted under the laws of the State of Georgia. No Construction Against Drafter. Should any provision of this Agreement require interpretation in any judicial, administrative or other proceeding or circumstance, it is agreed that the court, administrative body, or other entity interpreting or construing the same shall not apply a presumption that the terms hereof shall be more strictly construed against one party by reason of the rule of construction that a document is to be construed more strictly against the party who by itself or through its agents prepared the same, it being agreed that the agents of all parties hereto have fully participated in the preparation of this Agreement. Default; Enforcement. In the event of a default hereunder, the parties hereto shall have all remedies available at law or at equity for the enforcement of the provisions of this Agreement. Sweeney, Inc., said that he would check the dumpster cover at 1701 Chatham to make sure it has not blown off. He assured me that the dumpster is on the property—not blocking the neighbor's driveway. I visited the site and attached is the site plan.The dumpster is 8-feet wide.The access easement is 20-feet wide.The dumpster may be encroaching into the easement by 1 foot, leaving 19 feet for a one-lane access road. As the site plan shows,the old gravel drive encroached onto the property.The shift of the drive lane off of the duplex property and into the access easement will be permanent.
