THE MINUTES OF THE JANUARY 1988 MEETING WERE APPROVED UPON MOTION BY
JEANNE WHITING WITH A SECOND BY LARRY COLEMAN. THE MOTION PASSED.

Chief Ferris reviewed the written police report for January which
is attached to these minutes. He reviewed an incident at the cul de sac
at Points Drive where a driver from the Kirkland side of the road
closure drove across the median strip and took out one third of the
shrubs planted there. He was charged with reckless driving and the
Towns can recover the cost of the shrub replacement through court
proceedings . He has called the Town and is interested in making
restitution. The information has been sent to the Town attorney.
Ken Weinstein, Clyde Hill's Public Safety Director, reported that
Chief Ferris has recently been elected President of the King County
Chiefs of Police Association. Since the office is usually held by
representatives of larger communities, this election is a tribute to the
Chief's professionalism. He also reviewed current staffing projection:
for the Police Department. The position of sargeant is being upgraded
to lieutenant and two positions now being held by provisionals will be
filled by full time officers. A full time secretary has also been
hired.
ENGINEER'S REPORT
Town Engineer Alan Newbill reported on several options regarding
the cul de sac on Points Drive relating to the incident reported by
Chief Ferris. One option is to put in a guard rail. It could be
installed by a company in Sumner for an estimated $19 per foot which
would be $3525 for 175 feet. The guard rail would be installed inside
the curbing on the Kirkland side. Another option is installation of
jersey barriers at a coat of $18-20 per foot. They would be two feet

wide at the base. A concrete pad would be required underneath the
barriers. Installation costs could be an additional $2500. He estimated
a total cost for the jersey barriers of $6000. The Mayor requested that
Allan investigate other alternatives.
In response to a question Chief Ferris reported that a work order
has been issued for the removal of the temporary closure signs regarding
Points Drive.
Drainage on 91st Avenue: Further excavation of the Salvini property
by the Water District indicated that the problem appears to involve
culverts along the west shoulder of the street. Allan presented a
drawing illustrating the system that was discovered when Rotorooter was
used to investigate the whole system on the west side of the street. He
explained the drawing which is attached to these minutes. There is an
assortment of different sized pipes some of which are blocked, broken or
missing. Allan has prepared an estimate for replacing the system from
4233 91st north to 4415 91st, which would involve putting in one new
catch basin, repairing the one that does not have a grate on it now,
installing 170 feet of 12 inch pipe and cutting and repairing several
concrete or asphalt driveways. His estimate is about $11,000 for the
project, including some design and inspection work. He feels that this
may not totally solve the problem at the Saivinis' but the Town is
responsible for the drainage system in the right of way. The estimate
is for about $25 a foot plus engineering fees. There will be charges
forewarded from the Water District for the excavation done as well as a
bill for Rotorooter for their three hour minimum charge of $270. The
Mayor stated that he anticipated that if the Council chooses to proceed
with the project that the Arterial Street Fund which contains $60,000,
could be used. The Council requested that Allan prepare a preliminary
design for the project by the March Council meeting so that bids could
be awarded at the April meeting.
The Mayor reported on a visit he had with Mr. and Mrs. Baird
regarding the drainage problems on NE 33rd. He asked that Allan be
authorized to look into the problem regarding the lower catch basin and
the pipes that feed into it.
Arlys Gale asked about the sagging gate at the cul de sac. Allan
will get the contractor to repair it properly. The contractor has a
year's guarantee on his work in which to make repairs and adjustments.
BENDER CHAFFEY SIGN REQUEST
Don Bender presented a letter to the Council requesting permission
to install a sign at the Cichy property which he is purchasing. This
4x3 foot sign would be larger than the 2x2 toot sign allowed for a
single piece of property but smaller than the 4x8 foot sign allowed for
a subdivision of five acres or more according to Ordinance 256.
MEL FREEMAN MOVED THAT THE COUNCIL GRANT AN EXCEPTION TO THE SIGN
ORDINANCE FOR A SIGN NOT TO EXCEED THE SIZE AND CONDITIONS OF THE
PREVIOUSLY APPROVED SIGN FOR THE BENDER CHAFFEY THREE LOT DEVELOPMENT ON
THE EVANS ADDITION. CARSON WHEELER SECONDED THE MOTION. IT PASSED
UNANIMOUSLY.

ATTORNEY'S REPORT
Ron Dickenson reported that he will be preparing a written opinion
regarding use of the park property for Community Center.
ROTOVATION
Arlys referred to a letter received from the Department of Ecology
regarding the contractor who did the rotovation. The project was not
completed in the area outlined in the contract. The public beach was not
done. The Council requested that a letter be sent to Metro stating that
the Town is not satisfied with the results of the project. Ron's
recommendation is that the letter be written saying that they are not in
compliance with the contract. He will dictate the letter for the Mayor's
signature. A copy will be sent to DOE.
TREASURER'S REPORT
Anne Mitchell presented a written report to the Council and
reviewed the report for them. She explained her amended report for
December. She reviewed the cash situation and updated the LID process.
The notice offering the Bonds for purchase has gone to the
Journal -American for publication.
1988 BUDGET
After discussion of possible changes in the 1988 Budget as
presented at the last meeting it was decided not to amend Ordinance 328
at the present time.
MAYOR'S REPORT
The Mayor reported that letters will be going out tomorrow to
residents on 95th N.E. and N.E. 40th inviting them to a meeting on
Wednesday February 24th at 7:30 for a presentation of the preliminary
plans for the Community Center. A later meeting will be set for review
by the whole Town. Ideas are being solicited for recommendations
regarding donations.
Baird- Foley Property Update: The Mayor reported on his meeting
with the Sairds regarding the property. It is anticipated that the
matter will be ready to go to the Planning Commission at their April
meeting.
CLERK'S REPORT
The Deputy Clerk reported in the Clerk's absence. A request has
been received from a resident for a Dead End sign at N.E. 34th Street
and 92nd. It was decided to table the matter for father consideration
at a later time.
After an increase in complaints regarding uncontrolled dogs, the
Clerk arranged with King County Animal Control for an additional patrol
which apparently took place on the following Sunday.
Questions regarding building in the Town right of way have been
referred to the Building Official and Town Attorney and will probably be
on next month's agenda. The Clerk was directed to proceed with the
Substantial Development Permit on the beach erosion project.

ANNOUNCEMENTS
Jeanne Whiting announced that the Democratic Caucus meeting will be
held at Clyde Hill Elementary School. It was decided to reschedule the
Town Council meeting for Wednesday, March g at 7:30.

By motion of Mr. Coleman an'd second of Ms. Whiting, the Council moved to adopt
ordinance #330 finalizing the assessment for LID #2.
There being no further business, Mayor Lile adjourned the Joint Council Meeting
at 8:20 p.m.
Mayor Richards explained to Mayor Lile that the City of Medina had expressed
interest in undertaking police services for the Town of Yarrow Point, and .that
if Yarrow Point was considering a change .from the recently executed 198E-1989
Police Services Contract, that Clyde Hill should be so informed. Mayor Lile
stated that Yarrow Point was not presently considering a change in services,
and that they were Quite satisfied receiving police services from Clyde Hill.
He advised that there had been no formal proposal submitted by Medina as yet,
and that the matter would receive no consideration until formal proposal was
made. Mayor Richards stated that he would still favor a "commission" with
representatives from Yarrow Point to oversee the police services provided by
Clyde Hill to Yarrow Point.
Mayor Richards then thanked Yarrow Point acting as the lead agency in the Points
Drive Closure matter, and that their cooperation was very much appreciated.
Mayor Richards then recessed the regular meeting at 8:26 p.m.
Mayor Richards reconvened the regular meeting at 8:38 p.m.
"ENT N JAIL SERVICES CONTRACT
ayor Richards advised that this matter was still under consideration and therefore
will be continued until the Council meeting of March 1, 1988.
MAYOR RICHARDS - 1988 IN PERSPECTIVE
Mayor Richards addressed the Council on several issues past, present and future.
He stated that we had come a long way and should be proud of where we are.
Mayor Richards noted that there had been major improvements in several aspects
of the Town that must be continued, but that we also need to establish new
goals for the next four years. Mayor Richards then elaborated on the following
areas:
Staffing Goals. That Clyde Hill has reached a level which will be able to
provide excellent service to the citizens.
Development of Police De artment. There has been funding for a 7th officer
and the Civil Service Commission has completed the final process for an eligibility
list. Approximately 29 applicants passed the written, agility and oral exam.
The City of Bellevue also contributed Lt. Wehmeyer to partake in the examining
process. In addition, the Chief's evaluation had been reviewed and any weak
Points were strenuously emphasized to the officers.
Choate Budd was introduced and welcomed aboard as the new Public Works -Supervisor.
Completion of the Shell of the auxiliary building will probably commence within
the next several weeks. Stage II plans are almost completed, with capital
expenditures beyond 1988 Budget figures of approximately $15,000 expected.
We have been granted tentative approval to transfer the $12,000 Block Grant
Funds from the old Police building to the new addition.
Parks are to be improved with appropriate funds in the 1988 Budget, with plans
substantially increasing park area. This is in its preliminary stage.

Council Meeting - 2/2/88
An unidentified citizen expressed concern that buses travel too fast on 84th
and wondered if the Town could control the speed of Metro.
Mike Higgins, 8601 NE 12th, inquired of the Mayor as to whether the Town had
the authority to change the speed limit to 25 miles per hour, or to add a
bike lane.
Mayor Richards stated that the Town did have such authority, and that when
the Town is in a position to make a recommendation on the matter, that everyone
would be notified'•accordingly.
Mayor Richards then recessed the Council meeting at 7.35 for a brief break.
Mayor Richards reconvened the Council meeting at 7:41 p.m.
POINTS DRIVE CLOSURE - FINAL ASSESSMENT ROLL
Joint Public Hearin -- Clyde dill & Yarrow Point. Mayor Richards explained
to all present the relationship between Clyde Hill and Yarrow Point in the
Points Drive Closure matter, stating that the homes on the south side of Points
Drive are in Clyde Hill and the homes on the north side are in Yarrow Point.
Mayor. Richards then recessed the regular Clyde Hill Town Council meeting at
7:43 p.m. for a Joint Council Meeting between the Yarrow Point and Clyde Hill
Councils.
Minor Lile, Mayor of Yarrow Point, opened the Joint Council Meeting stating
that Yarrow Point has acted as the lead agency in the closure of Points
Drive. He then introduced Courtney Thomas, Town Clerk; Anne Mitchell,
Town Treasurer, and Council Members Jeanne Whiting, Arlys Gale and Larry
Coleman.
Mayor Lile then recited the document regarding the Final Assessment Roll
-of Points Drive Closure, indicating that any protest to be heard must be
done in writing. Mayor Lite opened the Joint Public Hearing at 7:45 p.m.
Clerk Thomas then read a letter from Dr.& Mrs. Dudley of 3430 92nd Avenue
NE, dated 1/17/88 regarding their two properties, one which fronts solely
on Points Drive, and the adjacent property which fronts on 92nd Avenue
NE and Points Drive.
Mrs. Dudley, 3430 92nd Avenue NE, was present at the meeting. She indicated
to Mayor Life that their letter was not in protest to the closure, and
that they were quite delighted with the closure. Mrs. Dudley expressed
that it was she and Dr. Dudley's understanding that they would only be
assessed for the dwelling they owned which had a Points Drive address.
Mrs. Dudley further indicated that at a Yarrow Point Council meeting several
years ago, Mayor Lite had told them they would only be assessed for the
one property. Their personal home is on 92nd Avenue NE. Mrs. Dudley, stated
that they would handle the large assessment, in any event.
Mayor Richards informed Mayor Lile that the Town of Clyde Hill received
a letter dated 2/l/88 signed by approximately five property owners on Points
Drive and which states that Clyde Hill should. match Yarrow Point's contribution
of $10,000 to the LID #2.

Mayor Lile then recited that letter dated 2/1/88 directed to the Town Council of
Clyde Hill stating that the homeowners on the south side of Points Drive
respectvully requested that the Town of Clyde Hill make a contribution to the
LID #2, in the amount of $10,000, matching a $10,000 contribution made by the
Town of yarrow Point. Mayor Lile stated that theYarrow Point Council considered
the following when making a contribution: 1) the final costs of LID #2 turned
out to be almost twice the original estimate; 2) the costs of studying alter-
native methods to solve the traffic problems were charged to LID #2. Mayor
Lice stated that the cost of the closure was being shared evenly between the
residents of Clyde Hill and Yarrow Point. Mayor Lile indicated that no further
written protests had been filed.
By motion of Mr. Coleman and second of Ms. Whiting, the Joint Public Hearing
was closed at 8:00 p.m.
Allan Newbill, engineer for Yarrow Point, advised that the ordinance should
set a fixed dollar amount.
Upon motion of Mr. Coleman.and second of No. Gale, the Council.moved to deny
the request of the Dudleys to be exempt from the final assessment roll regarding
Points Drive Closure.
Bond Counsel, Cynthia Weed, of Preston, Thorgrimson, stated that Clyde Hill's
consideration of making a contribution to the. LID should be done .at this meeting.
Mayor Richards reviewed petitions dated 2/1/88 and 7/28/83 relating to the
Points Drive Closure. He reviewed language on the petition which originally
requested permission to close Points Drive which stated: "Further, we understand
that we will be assessed for the various fees attendant to the formation of
an LID to include, but not be limited to, bond counsel services and charges
by the city engineer for LID preparation. Such fees will be included in the
final LID package, to become part of our total LID assessment." Mayor Richards
noted that the closure resulted in increased property value and safety to the
residents of Points Drive. Mayor Richards stated that the 1988 Budget did
not provide for a contribution and that it had been anticipated that the Town
would be reimbursed for the costs already spent. He advised that the suggested
donation would, in effect, bypass the normal budget and public hearing process,
and that the Town had to carefully consider all areas of need. Mayor Richards
reminded those present that the closure of Points Drive had caused a signifi-
cant increase in the traffic on NE 24th Street, which would require possible
expenditure of funds. He stated that nine homes were involved on Points Drive
and 58 residences front on NE 24th.
By motion of Mr. Horsfall and second of Mr. Hervey, the Council denied the
request made by the Points Drive property owners in their Petition dated 2/1188
for Clyde Hill to contribute $10,000 to the LID #2.
Mayor Richards stated that it had been a pleasure for the Town to assist the
property owners in achieving their goal.
There being no further comment, Mayor Lile closed the Joint Public Hearing.
By motion of Mr. Coleman and second of Ms. Whiting, the Yarrow Point Council
moved to close the Public Hearing at 8:18 p.m., indicating that the final, assess-
ment for LID #2 was $68,862.20.
