HomeMy Public PortalAboutResolution 04-42411 1 RESOLUTION NO. 04 -4241 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RESTRICTING THE PARKING OF COMMERCIAL VEHICLES ON ALL PORTIONS OF ROSEMEAD BOULEVARD WITHIN THE CITY BOUNDARIES AND ESTABLISHING THE PENALTY FOR PARKING VIOLATIONS ON ALL ESTABLISHED TRUCK ROUTES WITHIN CITY LIMITS WHEREAS, Temple City Municipal Code Section 3311 limits the parking or standing of any commercial vehicle upon an established Truck Route to a period of one (1) hour; and, WHEREAS, Division 11, Chapter 9, Section 22506 of the California Vehicle Code authorizes local authorities to prohibit or restrict the stopping, parking, or standing of vehicles on a state highway, in their respective jurisdictions; and, WHEREAS, Division 11, Chapter 10, Section 22651(n) of the California Vehicle Code authorizes local authorities to remove vehicles whenever a vehicle is parked or left standing in violation of a properly adopted and posted restriction on parking; and, ,WHEREAS, Temple City Municipal Code Section 3334 authorizes the City Council of the City of Temple City to set and /or modify, by resolution, the penalties for vehicle parking violations, late payment penalties, administrative fees and other related charges; and, WHEREAS, the City Council hereby determines unrestricted parking or standing of commercial vehicles on Rosemead Boulevard is detrimental to the health, safety, and welfare of the community; and, WHEREAS, the City of Temple City desires to restrict parking or standing of commercial vehicles on Rosemead Boulevard within the City limits; and, WHEREAS, the City has received the required preliminary California Department of Transportation approval to regulate parking on Rosemead Boulevard (State Highway 164/19). NOW THEREFORE, the City Council of the City of Temple City hereby resolves and directs as follows: SECTION 1: The requirement of Section 3311 of the Temple City Municipal Code shall henceforth be applied to Rosemead Boulevard, a City designated Truck Route. SECTION 2: Violation of the parking restrictions imposed by this Resolution shall subject violators to the sanctions provided in applicable Federal, State, and Local law, and the Los Angeles County Sheriff's Department, or any other duly authorized law enforcement personnel, is hereby authorized to issue citations or take other lawful action to enforce this Resolution. SECTION 3: The City Manager is hereby authorized to erect or install a minimum of thirty -two signs at the truck route entrances into the City stating "Tow -Away, One Hour Parking Limit for All Vehicles in Excess of 80" in width within the City of Temple City, Except Loading or Unloading." SECTION 4. Pursuant to Temple City Municipal Code Section 3334 the City Council hereby sets the penalties for commercial vehicle parking violations at the following applicable bail amounts: • Penalty Amount $52.00 • Delinquent Amount $62.00 • Registration Hold Amount $82.00 • Impound /Storage Fee per Vehicle $80.00 Resolution No. 04 -4241 Page 2 SECTION 5: A Commercial Vehicle is hereby defined as any vehicle in excess of eighty (80 ") inches in width. SECTION 6: Commercial Vehicles parked in excess of one hour are subject to removal. SECTION 7: The City Manager may suspend enforcement of the provisions of this resolution for any period of time as the City Manager may, in good judgment determine is necessary for the efficient administration of the City. SECTION 8: The City Clerk shall certify to the passage and adoption of this resolution. PASSED, APPROVED, AND ADOPTED on this 3rd day of February, 2004.
