The annual racial profiling report from a state board analyzed 4.5m vehicle and pedestrian stops conducted by 535 law enforcement agencies, the first time departments from acrossthe state contributed data. The findings suggest there are persistent and severe racial disparities in overall stops and searches; transgender Californians are disproportionately impacted, and youth of color areheavily policed and frequently stopped in schools. Some key findings: Black residents were stopped the most, making up 5.4% of the state’s population but 12.5% of stops. Latinos were also disproportionately stopped, making up 32.4% of the population but 42.9%of stops. White and Asian American residents were stopped at lower rates than their proportion of the population. Native Americans were searched most frequently compared with all racial groups, in 22.4%of stops, nearly twice the rate of white people, who were searched in 12.4% of stops. Native Americans were also handcuffed at the highest rate of all groups at 17.8% of stops,compared with less than 10% for white people. Black residents were detained on the curb or in a patrol car at the highest rate, at 20.2% of stops, and also ordered to exit their cars more frequently than all other groups, at 7.1% ofstops. Black residents were also issued a sole charge of resisting arrest at a rate more than three times the state average, making up 19.2% of those cases. The data suggests broad bias in police stops of people of color, a trend that has beenrepeatedly documented in government and advocacy groups’ reports. Discriminatory policing can come in the form of “pretext stops” when an officer pulls someone over for a minor infraction and then uses the stop to investigate other potentialoffenses, such as searching for drugs. In 75% of all stops, officers reported that they ultimately took no action. While white people were less likely to be searched than nearly allother racial groups, they were the most likely to be found with contraband or other evidence of crimes when they were searched. Police also took actions against trans people significantly more frequently than cisgenderpeople: roughly 50% of all trans people stopped by police were either searched, detained, handcuffed, ordered out of their cars, or had other actions taken against them, while that ratewas 27.4% for cis men and 19.1% for cis women. The racial and gender data is based on officers’ perceptions of their identities. The research is conducted by the state’s Racial and Identity Profiling Advisory (Ripa) board, whichincludes academics, civil rights advocates, and law enforcement leaders. “The scale of data that California is collecting allows us to say definitively that profiling exists – it is a pervasive pattern across the state,” said Andrea Guerrero, co-chair of the Ripaboard, in a statement. Youth stops The board’s research this year, the report said, also suggests “youth with disabilities, including youth experiencing mental health crises, are particularly vulnerable to policeviolence and are at higher risk of intrusive police contact, use of force, and death during police encounters”. Officers reported making 6,441 stops of students on K-12 public campuses in 2022. TheKern County High School district in the Central Valley conducted 545 stops of students, the most in the state. The Los Angeles Sheriff’s department had at least 132 deputies assigned toschools at some point in 2022, and they conducted 245 stops of students. The most common reason for stopping students was reasonable suspicion of a crime (3,705 cases, representing57.53% stops). At least 1,143 students (17.75% of stops) were stopped “to determine whether the student violated school policy”, the report found. Black students were handcuffed on campus at rates nearly double their counterparts: Blackyouth were handcuffed in 20.03% of stops. The rate was 11.73% for Asian Americans, 11.07% for Latinos, and 9.13% for white students. In 10 stops in 2022, officers reportedusing pepper spray. The report also found that California school districts have a larger number of law enforcement officers than social workers and more security guards than nurses. There are also 19 school district-run police departments across the state, which are separate frommunicipal police agencies, and the majority of students in those districts are youth of color. “School-based law enforcement officers in white suburban school districts more often [view] students as charges to be protected, and school-based law enforcement officers inurban districts with a larger number of Black students more often [treat] students as criminals to be feared,” the report said, citing research on-campus police. The report recommends that school districts require staff to obtain approval fromadministrators before reporting students to police in non-emergency matters and that lawmakers prohibit police from using force to detain, apprehend or overcome resistance ofstudents who are fleeing in low-level disciplinary cases. The authors also recommend that police and school security officers be prohibited from using mechanical restraints onstudents unless they pose a serious risk of harm to themselves or others. “We have our priorities wrong,” said Jerlene Tatum, an education advocate in Long Beach. “If we had additional school counselors and psychologists, we wouldn’t have to depend onlaw enforcement as much. Police are there to police. They’re not there to educate, inspire, engage, and support a child to advance in their academics.” After a school officer in Long Beach fatally shot an 18-year-old girl in 2021, Tatum was partof a group of parents that organized for reforms and the dismantling of armed forces on campuses. “There’s a trauma that comes with being handcuffed,” she said, adding, “And it contributesto the cradle-to-prison pipeline. This isn't publishing a scientic paper, but still why do that? If it can be trained with 50 trials to do complicated tasks, with current AI, enterprises willbe plenty willng to do that if the robot can replace a human. Two unrelated notes: 1) Diane Feinstein, after years of paper shuffling by the Pentagon, got 7 old CoastGuard planes transferred to Cal Fire. They can deliiver 4,000 gal. of water and/or retardant onto a fire. KCBS reported recently that the first of the seven is now being converted to dothis job and could be ready BY THE END OF 2024. 4,000 gal. The Global Supertanker 747 we had was delivering 19,200 gal. per flight. Owned privately out of Colorado, it wentbankrupt. California was renting it for $16,000 per hour. I have urged repeatedly that we buy some 747s sitting in boneyards and convert them tosuch tankers. They are sitting aplenty in the Calif. desert east of LA. If they cost $50 million each to buy and convert, including new electronics because the old stuff got cooked by thedesert heat, 50 would cost $2.5 billion. Ten would cost $500 million. BUT NO. Now see item #2 below: KCBS, 740 AM in San Francisco, reported on December 13, 2023 that researchers atStanford have found that a wildfire, when it sweeps through an area containing lots of Chromium 3, converts lots of it to a really bad item in the smoke, hexavalent chromium, Cr6. One of the Stanford reseachers who did the study said on KCBS that "Chromium 6 is a Class 1 carcinogen". So, he said, "it is important to wear an N-95 mask when the air is full of wildfiresmoke. You do not want to inhale Cr6". They studied the area of a big fire we had in 2019. They laid a geology map over a wildfire map and looked. There was more Cr6 where there had been wildfires. There is no time associated with staff when the city of Palo Alto has a misleading and incomplete public record created by two City of Palo Alto employees who are paid by taxpayers/me.Period. My arborist and my structural engineer both came on site and evaluated the roots situation and delivered the complete reports sent to the city with the same conclusion that the redwood tree had to be removed regardless of the roots damage for either having roots running through the JADU foundation channel for which there is no solution to save the existing roots (Peter Golinger also agreed that is no solution to preserve the redwood tree roots) or into the existing house foundation. Unless the City of PA will take the liability for preserving the redwood tree roots, do not even talk about it since you want to preserve a tree at the owner's expense. Not happening. Peter Gollinger ignored those facts and, in the end, delivered a misleading report that suited him and his department and ask me to plant or pay the equivalent of 12- 24 box trees, $7800. Attached reports, again. Peter Gollinger, with his incomplete report and requesting the owner to plant 12- 24 box trees (or pay the city $7800), represents another barrier that the City of Palo Alto throws in front of developers building housing units when HCD repeatedly ordered the city of Palo Alto to stop placing barriers and build housing. I had a similar issue with Peter Golinger and Uriel Hernandez earlier this year when Urban Forestry accused me that I cut the shrubs/vegetation and one EST 9 inch diameter tree on city right away after I received email confirmation that the owner is responsible for maintaining the city strip. Furthermore, Peter Gollinger claimed that he and Uriel called me during that time and told me not to remove that EST 9 inch diameter tree. City phone records will prove that was a pathetic lie. If I am responsible for maintaining the city right away do not ask me later why I removed all shrubs, vegetation and a EST 9 inch diameter tree that all impacted the light into the property and was overgrown/20-25 ft high. I am demanding that the city of Palo Alto City Council investigate this entire behavior and departmental actions by City of PA employees. The base of Appeal: The reason for Redwood tree removal that generated themitigation planting requirement included as a condition of 23TRE-00157/23BLD-02245 Reason for Appeal: The owner disagrees with UF's assessment of the redwood tree's reasonfor removal because of the damage inflicted to the redwood tree roots vsredwood tree roots running into the Existing foundation emphasized bythe attached structural letter and therefore, disagrees with UF's request toplant 12 trees as a replacement for the redwood tree when the ownershould be responsible for replacing it with only 3 24-box trees. 1. After the urban forestry completed their NOV report on 11/21/23 I asked thequestion why nobody was talking about the current redwood tree roots runninginto and close to the existing foundation and I did the exploratory roots andproved to be the case and got structural engineer letters that point out that thecurrent redwood roots indeed will have an impact into the existing foundation,therefore, it does not matter if the roots were impacted/damaged since underthe PA UF tree regulation any tree that impacts the structural foundation canbe removed at owner's request and replaced with the proper number of treesbased on the size of the canopy. The City of PA did not ask the property ownerto do more exploratory trenching in the proposed JADU area, which wouldhave turned out an earlier discovery of the existing redwood roots some veryclose to the surface. In the end, the redwood tree roots were found, and the cityof PA now blames the property owner. The key here is that with the redwoodtree system discovered between 11/29-11/30 that there was no way that theJADU could be properly built in the area without removing the tree. I expectguidance from UF not to blame me at the end and to make me responsible forfinding that the redwood tree roots were running into the existing foundation.See attached pictures. This entire redwood tree exploratory trenching couldhave been ordered by the city dating back in March 2023 when we discussedand discovered that the Cedar tree in the rear had roots running into theexisting foundation and was permitted to be removed under my structuralengineer letter requiring immediate removal (see attached permit) and theredwood tree roots impacting existing foundation is no different. 2. Redwood Tree roots discovered during the trenching of the new JADUfoundation were running into the future JADU foundation that has a permit(BLD23-02245) approved meaning the structure cannot be changed.The owneris not going to take on any liability that the roots system that runs across the entire JADU trenching channel, the GC cannot offer any foundation warrantyand city does not want to be liable for future foundation damages/claims so therefore the redwood tree had to be removed per structural and arborist reportregardless of damaged or intact roots. NOV notice has inaccurate info as follows: 1. TPZ verification was signed off by Uriel on 11/3/23 see attached screenshotmeaning we passed TPZ not as stated that posts were missing which was after the fact brought up to owner's attention and installed the same day. This"fencing" fine was also included in the $3,000 citation. See attached email. 2. UForestry had the chance to provide comments during the 3 reviews that wehad till BP was approved and they were on site and never pointed out if we had issues. Owner suggested to UF in March 2023 to also do an exploratory onthe redwood tree roots to see if we can find any roots but did not have any guidance even during BP review process 8/18/23-11/2/23 when buildingpermit was approved. 3. We urge you not to do so. The war is an international matter with world-wide implications. It is not within the capability of the Palo Alto City Council to completely assess all of the incredibly complex ramifications as to whether a cease fire would bring a meaningful cessation to the current hostilities and, equally importantly, completely eliminate the potential for future hostilities. While a short-term cease fire would reduce causalities on both sides, a desirable result of course and possibly lead to the return of some of the hostages, a permanent cease fire would be a strategic victory for Hamas and other non-state actors seeking the total destruction of the State of Israel. For eighteen years I had the great privilege of working as Executive Director of Harvard Hillel. As a leader of Jewish communities on campus, in New England, and around the nation, I have helped cultivate a new generation of Jewish leaders and citizens. I navigated momentsof tension and war: the tumultuous 1990s, as the Oslo Accords began to crumble; the Second Intifada; 9/11 and its fallout; the Iraq War; Israel’s Second Lebanon War and its waron Gaza in late 2008. During my long career as a Jewish educator and leader — including thirteen years living inJerusalem — I have seen and lived through my community’s struggles. Now, as an elder leader, with the benefit of hindsight, I feel compelled to speak to what I see as a disturbingtrend gripping our campus, and many others: The cynical weaponization of antisemitism by powerful forces who seek to intimidate and ultimately silence legitimate criticism of Israeland of American policy on Israel. In most cases, it takes the form of bullying pro-Palestine organizers. In others, thesecampaigns persecute anyone who simply doesn’t show due deference to the bullies. The recent effort to smear our new University President, Claudine Gay, is a case in point. Iapplaud the decision by the Harvard Corporation to stand by Dr. Gay amid the ludicrous charges that she somehow supports genocide against Jews, and I hope Harvard will continueto take a clear and strong stance against any further efforts by these powerful parties to meddle in university affairs, especially over personnel decisions. The toppling of the president of the University of Pennsylvania is a sobering example of what can happen when we empower these unscrupulous forces to dictate our path asuniversity leaders. The stakes are as high as they’ve ever been. Our vigilance must be up to the task. As a leader in the Jewish community, I am particularly alarmed by today’s McCarthyist tactic of manufacturing an antisemitism scare, which, in effect, turns the very real issue ofJewish safety into a pawn in a cynical political game to cover for Israel’s deeply unpopular policies with regard to Palestine. (A recent poll found that 66 percent of all U.S. voters and80 percent of Democratic voters desire an end to Israel’s current war, for instance.) What makes this trend particularly disturbing is the power differential: Billionaire donorsand the politically-connected, non-Jews and Jews alike on one side, targeting disproportionately people of vulnerable populations on the other, including students,untenured faculty, persons of color, Muslims, and, especially, Palestinian activists. Let me speak directly to Jewish students at Harvard. I know that it’s alienating and hurtful to so many of you when campus Jewish organizations, like Hillel and Chabad, take positions that exclude your voices. To those students, I say: TheJewish tradition is much deeper than any organization. No one has a monopoly on Judaism. Continue to learn Torah, Jewish history, and our ethical traditions. Continue to draw fromthese sources — your sources — to find yourself, to build community, to build your own power, and even to build your own Jewish organizations. Be boldly critical of Israel — not despite being Jewish, but because you are. There is no tradition more central to Judaism than prophetic truth-telling, no Jewish imperative moreurgent than bravely criticizing corrupt leadership, starting with our own. As someone who spent over forty years running programs in which Jews, often youngpeople, were under my care, the safety of Jews has always been my highest priority — and, frankly, the thing that keeps me up at night. I have myself been the victim of antisemitism,including, on more than one occasion, serious violent attack. I know what antisemitism looks like and I do not take the issue of violence against Jewslightly. I have monitored, with vigilance, the kinds of speech that Israel-aligned parties are calling “antisemitic,” and it simply does not pass the sniff test. Let me speak plainly: It is not antisemitic to demand justice for all Palestinians living in their ancestral lands. The activists who employ this language, and the politics of liberation, are sincere people; their cause is a legitimate and important movement dissenting against the brutal treatment ofPalestinians that has been ongoing for 75 years. One can disagree with any part of what these activists say, but they must be allowed to speak safely and afforded the respect theirmorally serious position deserves. I have learned much by listening and carefully considering the positions of these activists. If Israel’s cause is just, let it speak eloquently in its own defense. It is very telling that some of Israel’s own supporters instead go to extraordinary lengths to utterly silence the otherside. Smearing one’s opponents is rarely a tactic employed by those confident that justice is on their side. If Israel’s case requires branding its critics antisemites, it is already concedingdefeat. Let me be clear: Antisemitism in the U.S. is a real and dangerous phenomenon, mostpressingly from the alt-right white-supremacist politics that have become alarmingly mainstream since 2016. To contend against these and other antisemitic forces with clarityand purpose, we must put aside all fabricated and weaponized charges of “antisemitism” that serve to silence criticism of Israeli policy and its sponsors in the U.S. As a Jewish leader, I say: Enough.
