Any and all trees and structures located within the boundaries of the above described permanent casement areas are included in this taking; structures and facilities so located that are owned by private - utility companies are not taken. - - - -The above-described temporary construction easements shall . terminate automatically three (3) years from the date of the recording of this instrument, without the necessity of recording any further instrument with said Deeds. The lands determined by the Town Council to be affected by the herein taking are owned or supposedly owned by the owners listed in Schedule A, attached hereto and incorporated within. If in any instance the name of any owner is not correctly stated in Schedule A, it is understood that in such instance the land referred to is owned by an owner or owners unknown to us. Appraisal and damages having been waived by the owners listed in Schedule A; accordingly, the Town awards no damages for these takings. No betterments are to be assessed for the improvements for which the herein easements are taken.
