RESOLUTION NO. 76=k , REGARDING CONVEYANCES OF PROPERTY
WHEREAS Minnesota Statutes 462.358 permits the filing or
recording of conveyances of property consisting of 5 acres
or more without municipal approval; and
WHEREAS the Medina City Zoning Code and the zoning codes of
numerous other cities throughout Minnesota place certain
restrictions on the divisions of properties into tracts of
5 acres or more; and
WHEREAS such restrictions are to the benefit of the public
health, safety and welfare and, for example, require the
platting of such properties where new roads are involved or
where the land is not capable of supporting on -site septic
drainage systezrs without special provisions; and
WHEREAS the present law permits sales and conveyances which
result in confusion among buyers, sellers, and municipal
officials;
H0W, THEREI+'ORE, BE IT RESOLVR0 that the Nedina City Council
does hereby support the repeal of Minnesota Statutes 462.358,
Subdivision 4 (4); and
BE IT FURTHER RESOLVED that the copies of this resolution
sent to appropriate state legislators serve as our request
that this action be taken in the interests of better city
planning.
