RE: Proposed Resolution 40-92
The following is furnished in accordance with Resolution 22-92 .
City Council Resolution 1-86 is subject to the interpretation
that the appointed Administrator, rather than the elected Mayo,
is the "Chief Administrator Official" with "Superintending
Control" of the City officers and affairs . Resolution 1-86 is
also open to the interpretation that the Administrator will
develop and implement administrative processes subject only to
the "advice" of the Mayor. Likewise Resolution 1-86 calls the
City Administrator a participating "member" of all City boards
and commissions, notwithstanding the procedures for the
appointment of their member and their terms of office, and thus
varies from the City Code and the Idaho Code, whereas the
Administrator in fact acts as staff or provides for staffing by
others .
Since it is not desirable for governing documents to be open to
interpretations at variance with the law, this proposal
Resolution 40-92 is intended to provide for all the duties and
responsibilities as originally set forth in Resolution 1-86, to
essentially remain intact but to be carried out subject to the
direct and final approval of the Mayor as provided by Idaho Code
Section 50-602 .
Resolution 40-92 will not impose any change in the present method
of operation.
