HomeMy Public PortalAboutResolution 37-92 Authorizing the purchase of a compressor for the fire department, authorizing additional overtime pay for the police and fire departments RESOLUTION NO. 37-92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO, DECLARING AN EMERGENCY; AUTHORIZING THE PURCHASE OF A COMPRESSOR FOR THE FIRE DEPARTMENT, AUTHORIZING ADDITIONAL OVERTIME PAY FOR THE POLICE AND FIRE DEPARTMENTS TO SAFEGUARD LIFE, HEALTH AND SAFETY OF THE COMMUNITY, ITS RESIDENTS AND VISITORS AND PROPERTY THEREOF, ORDERING THE EXPENDITURE OF FUNDS THEREFOR, ORDERING THE BORROWING OF SUCH FUNDS, ORDERING THAT A TAX LEVY BE IMPOSED TO PROVIDE FOR REPAYMENT OF SUCH FUNDS AND INTEREST, AND PROVIDING AN EFFECTIVE DATE. WHEREAS dry weather conditions noted in Resolution 25-92 have persisted and become exacerbated, and sufficient rains to end the problem are not possible, let alone in sight; WHEREAS the existing Fire Department compressor has suddenly failed and cannot be repaired and a compressor is necessary to fill breathing apparatus tanks worn by firefighters under smoke conditions; and timely replacement cannot be assured without dispensing with competitive bidding; WHEREAS the incident of fires has been high, the City Fire Department has been obliged to render assistance under mutual aid agreements to the Southern Idaho Timber Protective Association and others for unanticipated fires; and the payroll account of the Department will be exhausted prior to the beginning of the next fiscal year; WHEREAS the crime rate in McCall during August was twice that of last year, and the rate for the year to date has run at least 33% higher than during the prior year, and crimes are occuring that there are no funds to investigate, all of which creates a need for unanticipated ordinary and necessary expenditures; WHEREAS the expense of crime and disturbance suppression and response to fire and other emergencies during the long Fourth of July weekend exceeded all projections, and civil disturbances were barely avoided at considerable expense; and WHEREAS the Police Department will exhaust its payroll appropriation prior to the end of the fiscal year by reason of these casualties, and the Community' s safety is at risk; BE IT RESOLVED by the Mayor and Council of the City of McCall that : Section 1 . The Mayor and Council declare a fire emergency pursuant to IC 50-1006, and 50-341 (L) by reason of such extreme weather conditions, and that the public interest and necessity demand the immediate expenditure RESOLUTION NO. 37-92 September 10, 1992 of public money for the purchase of a compressor and the meeting of payroll in order to safeguard life, health and property under IC 50-1018 . Section 2 . The Mayor and Council declare pursuant to IC 50- 1006 and IC 50-1018 that the public interest and necessity demand the immediate expenditure of public money for the the meeting of payroll in order to safeguard life, health and property through continuing the activities of the police department, including special investigations . Section 3 . The Mayor and Council are authorized to borrow $9, 300 for the use of the Fire Department, and $6, 500 for the use of the Police Department, and to issue warrants to West One Bank in such amounts, bearing interest not to exceed 6%. Section 4 . Pursuant to IC 50-341 (L) such expenditure for the compressor shall be made without compliance with the competitive bidding provisions of IC 50-341 . Section 5 . Such sums and interest shall be added to the amount authorized to be raised in the general tax levy for fiscal 1993, and embraced therein, in the amount of $15, 800 principal plus an amount of interest estimated to be $375 . WHEREAS, Dry weather conditions of the past year and extreme heat for extended periods during this summer have • created a situation wherein the moisture level of combustible materials has resulted in an unusually extreme fire hazard in the City of McCall; WHEREAS, this condition is expected to continue for some time and the ability of the existing fire apparatus of the city to cope with such extreme conditions is limited and inadequate; WHEREAS, the purchase and outfitting of additional fire apparatus consisting of a fire truck and equipment therefor shall expand the equipment available to the fire department to utilize in fighting fires occurring in the city thereby in- ", creasing the ability of the fire department to safeguard life, health and property; WHEREAS, such extreme fire danger does not permit the advertising and letting of bids and the city can acquire such fire apparatus and equipment therefor through negotiation at prices lower than those attainable through the competitive bidding process; and WHEREAS, the city does not have funds on hand with which to purchase such fire apparatus and equipment and such extreme fire danger does not allow time for a bond election to provide funds for such purpose. NOW, THEREFORE, be it resolved by the Mayor and Council of the City of McCall, Idaho: Section 1. That the Mayor and City Council declare that an emergency exists by reason of such extreme weather 4 3 • conditions and that the public interest and necessity demand the immediate expenditure of public money for the purchase and outfitting of fire apparatus in order to safeguard life, health and property. Section 2. That the Mayor and City Clerk are hereby ordered to borrow the sum of $66,844.00 to provide for the purchase and outfitting of such fire apparatus for a space of time not to exceed the close of the next fiscal year. Section 3. That pursuant to Section 50-341(L) , Idaho Code, such expenditure shall be made without compliance with the competitive bidding provisions of said Section 50-341, Idaho Code. Section 4. That such sum and interest in the amount of $3,500.00 shall be added to the amount authorized to be raised in the general tax levy for fiscal 1989, and embraced therein. Section 5. Adopted and approved this l( day of August, 1988. • _ likI � ' r , Attest: City C] - • • • • RESOLUTION NO. 25-92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO, RELATING TO FIREWORKS AND THE DROUGHT, AND IN SUPPORT OF RESOLUTE ACTION BY THE FIRE CHIEF . WHEREAS : 1 . The State of Idaho and Valley County have had six years of drought, and the Palmer Drought Index lists Central Idaho, of which Valley County is part, as being in "extreme" drought conditions; 2 . The 50-year average for rain in May is 2 . 30 inches, but thus far we have had only . 11 inches of rain; 3 . The long-range weather forecast calls for below normal rain and above normal temperatures; 4 . According to measure by the USFS the moisture content in this area for 1, 000 hour fuels is 15%, as compared with an industrial standard for kiln-dried lumber of 23%; 5 . Fireworks are a known ignition source for fires; 6. The Uniform Fire Code and the McCall City Code give the option to the Fire Chief to declare an extreme fire hazard area and condition exists, as a consequence of which declaration the use and possession of fireworks becomes illegal; and 110 7 . The Fire Chief desires and plans to declare that such a fire hazard area and condition exists within the City of McCall; BE IT RESOLVED by the Mayor and Council of the City of McCall that : Section 1 . The Mayor and Council concur in the judgment of the Fire Chief, commend his willingness to stand upon principle, and direct the Police Chief to cooperate in enforcing the ban on fireworks use and possession. The continued drought in our area has increased the probability of a wildiand urban interface conflagration within our City. The subdivision near Cascade last year nearly suffered this catastrophic loss . The probability of a fire of the magnitude of the Oakland or Spokane , North Idaho complexes only increase as the fuel moisture continue to drop and temperatures climb to summer levels . Should these factors continue I would ask you to prepare emergency ordinances now that would ban the sale and use of all fireworks , including so called safe and sane , that could he implemented immediately without waiting for the normal hearing process at the time when the need for implementation occurs . I propose that this be only a temporary measure and subject to review each year as the need arises . Fire prevention is the least expensive and most productive when properly executed. Let' s take this step now to protect our beautiful City rather than wait and hope it does not happen to us . I truly hope we will not have to answer the question "why doesa disaster have to occur before anything is done . " As you are aware this has been a concern of mine for sometime. I wish not to cause hardship on civic and charitable organizations who use this occasion as a fund raiser, nor am I against motherhood and apple pie , but I feel with all the factors properly considered this course of action is imperative to ensure our City will remain the most beautiful place in the state to visit and live. Box 1597 McCall, ID 83638 Dear Chief Points: I am writing this letter to support your request to both the County Commissioners and the City Council to ban the sale and use of all fireworks over the 1992 Fourth of July Holiday. We normally do not issue any burning permits for the period of July 3 through 7 just because of the danger of heavy wildfire activity during that period of time. The drouth and early spring have resulted in very dry fuels already this spring. If the hot dry weather continues, fireworks could cause serious 1111 losses in the City and County. I support the need for ordinances to prevent the sale and use of any type of fireworks this year. Citizens could still attend the organized, City sponsored fireworks display over the lake to celebrate our Nation's independence. If the ordinances are in place and then the weather changes and brings heavy rains, the ordinances could be lifted to permit normal use of safe and sane fireworks. As you well know, fireworks are not allowed at anytime on National Forest land as we feel they are extremely dangerous as a wildfire ignition source. The Payette National Forest would definitely endorse a fireworks ban for this year, because of the extreme drought conditions we are experiencing and the 30/90-day National Weather Service forecast which projects above-normal temperatures and normal to below-normal precipitation. We have had only two months since last May where the monthly precipitation rose above the fifty Pr year average--November and April. Precipitation for April only exceeded the average by- 0.29 inches. Precipitation to date for May is 0.11 inches with the fifty year average for the month standing at 2.30 inches. The most recent Palmer Drought Index shows this part of Idaho in "extreme" drought. This is the most severe category on that scale. We are also very concerned this year about the potential for fires in an urban/wildland (forested) setting which could cause significant threat to, not only those structures, but adjacent lands. We have several such areas, but yours are far more numerous. Consequently, the elimination or substantial reduction of potential human-caused ignition sources would be very beneficial. L Your proposal could be viewed by many as an overreaction or unnecessary, but the critical nature of the situation seems to warrant extraordinary measures. City Administrator Re: Resolution 25-92 Dear Bud: In view of the lack of change in our weather condition, I feel it is time to declare a High Fire Hazard area in the City of McCall and invoke Resolution 25-92 . I have had several conversations with Gene Benedict .r'iu ror the Payette National Forest, no change has occurred in the Palmer Drought Index for our area. Fuel moisture content is now ranging from 8% to 1.4% in forested areas . Bill Williams withIPA also agrees that give the 3u-60-90 day forecast from the Forest Service , continual above normal temperatures and below normal precipitation, we are faced with the probability of a extreme fire danger in our area. Would you please pass this on to the mayor and council . We will continue to monitor these conditions and should a substantial rainy period follow in June we will update our decision. I have every intention of making our decision known to the press and TV in Boise , Lewiston and Moscow.
