RESOLUTION NO. 04 -4250
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY AUTHORIZING THE CITY MANAGER TO SUBMIT AN
APPLICATION FOR THE SB 1346 RUBBERIZED ASPHALT CONCRETE
GRANT PROGRAM
WHEREAS, Public Resources Code (PRC) Section 42872, authorizes the California Integrated
Waste Management Board (CIWMB) to establish a grant program to provide opportunities to divert waste
tires from landfill disposal, prevent illegal tire dumping, and to promote markets for recycled- content waste
tire products; and,
WHEREAS, the CIWMB has been delegated the responsibility for the administration of the
program within the state, setting up necessary procedures governing application by individuals,
businesses, and research institutions under the program; and,
WHEREAS, said procedures established by the CIWMB require the applicant to certify, by
resolution of approval of the application before submission of said application to the State; and,
WHEREAS, if awarded a grant, the applicant will enter into an agreement with the State of
California to implement the rubberized asphalt concrete project.
NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve, declare, determine,
and order as follows:
SECTION 1. The filing of an application with the CIWMB for a SB 1346 Rubberized Asphalt
Concrete Grant; and,
SECTION 2. The City Manager or his designee, is hereby authorized to take all actions
necessary for the purposes of securing grant funds and to implement and carry out the provisions
specified in the SB 1346 Rubberized Asphalt Concrete Grant application including but not limited to the
execution of applications, contracts, agreements, amendments, and payment requests; and,
SECTION 3. In accordance with the requirements established by the CIWMB, the City Manager is
hereby authorized to adopt the Recycled Products Purchasing Policy; and,
SECTION 4. The City Clerk shall certify to the passage and adoption of this Resolution.
