AN ORDINANCE AMENDING THE TEXT OF THE CIJTY OF GREENCASTLE,
INDIANA ZONING ORDINANCE AND SUBDIVISION CONTROL
ORDINANCE
WHEREAS,the City of Greencastle (the City) replaced its Zoning Ordinance and
Subdivision Control Ordinance November 28, 2022;
WHEREAS, it is desirable, and in the City's best interests to amend the Zoning
Ordinance and Subdivision Control Ordinance as indicated be'ow.
NOW THEREFORE be it ordained by the Comm n Council of the City of
Greencastle that it hereby amends the following sections o the Zoning Ordinance and
Subdivision Control Ordinance in the Greencastle City Code o read as follows:
ZONING ORDINANCE

Amendment to zoning text of the City of Greencastle Zonin Code
Petitioner: City of Greencastle
WHEREAS, the Plan Commission of the City of Greencastle initiated and prepared the attached
Ordinance to amend the Greencastle Planning and Zoning Ordinance amending the zoning text;and
WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this
ordinance on November 28, 2022 after timely notice of the heari4 was given by publication in the
Banner Graphic, Greencastle, Indiana,on or before November 18, 2022;and
WHEREAS,the Greencastle Plan Commission has reported that it pail reasonable regard to the following
factors enumerated in 1.C. 36-7-4-603 in consideration of the ordinance and determination of a
recommendation to be made to the Common Council:
1. the comprehensive plan;
2. current conditions and the character of current structures aid uses in each district;
3. the most desirable use for which the land in each district is adapted;
4. the conservation of property values throughout the jurisdic ion;and
5. responsible growth and development.
NOW THEREFORE, the Greencastle Plan Commission hereby certifies this ordinance to the Common
Council with a favorable recommendation.

P22-06 Zoning Ordinance Amendments related to the City of G eencastle Zoning Ordinance,Section
2.13 and 2.21
Hotels have been prohibited in Central Business District at least since 2002.That probably reflected an
attitude that quality hotel developments would not be interestelin a central business location. It was
also likely perceived as putting pressure on limited downtown pa king. With the revitalization of the
Central Business District, especially with its close proximity to higk visitation areas like DePauw as well
as other special events, it may be possible to attract hotels for u ique accommodation purposes.
The Greencastle Plan Commission met on Monday, November 28 to review the attached staff report
recommending that hotels be allowed as a Special Exception in Cntral Business district. Although the
question was raised regarding the possibility of letting hotels apply for a Variance of Use on a case-by-
case basis, it was pointed out that this would require the property owner to prove that the structure
had NO other possible CB District permitted use but as a hotel. It would also eliminate the possibility of
allowing new construction for hotel use.
Discussion was held about parking review for hotel approvals. Ultimately,the commission agreed that
requiring a Special Exception approval through the Greencastle Board of Zoning Appeals would create a
public review process (see Special Exception criteria in staff report)which would allow the board to
determine if a proposed development would meet the required criteria.
After reviewing the proposal under an advertised public hearing, and receiving no public comments for
or against the proposal,the commission unanimously passed a recommendation to include Hotels as a
Special Exception use in the Central Business District based on review and consideration of the
following:
1. The comprehensive plan;(Greencastle Comprehensive Plan Land Use Objectives One and
Three promote land use consistent with Greencastle' small-town character, and facilitate
safe and efficient pedestrian and vehicle movement t roughout the community. Growth
Management Objective Four encourages the investm nt and redevelopment in the
downtown.)
2. Current conditions and the character of current struc ures and uses in each district;
(Downtown vibrancy has grown to the point where t ere is demand to provide overnight
accommodations downtown.)
3. The most desirable use for which the land in each dis rict is adapted; (It is desirable to
provide overnight accommodations in the Central Bu iness District area.)
4. The conservation of property values throughout the j risdictlon; (It will enhance shopping,
eating and entertainment opportunities in the Centr I Business District.) and
5. Responsible growth and development. (Central Busin ss District development standards can
adequately guide any new construction or building r use.)

NEW BUSINESS—
The Greencastle Plan Commission has made amendments to our toning districts from time to
time as needed to support appropriate development opportunities. In 2020,Assisted Living
Facilities was added to Professional Business District as a permitted use. In 2019,
Hospital/Medical Center was removed from Central Business and University District. In'2017,
Banquet/Assembly Hall was added as a Special Exception in Ag/R ral Dwelling District.

Hotel Use in CB District

With the revitalization of the Central Business District, especially With its close proximity to high
visitation areas like DePauw as well as other special events, it may be possible to attract hotels
for unique accommodation purposes.
Here are definitions from our current code:
• $gtelLA building in which lodging is provided and offered to the public for compensation,and in
which egress and ingress from all rooms is made through an inside lobby or office.
• Motel:An establishment consisting of a group of attached or d �tached living or sleeping
accommodations with bathroom and closet space,located on a s'ngle zoning lot,and designed for
use by transient automobile tourists. A motel furnishes custom services such as maid service
and laundering of linen,telephone,secretarial,or desk service, nd the use and upkeep of
furniture. See also Hotel.

standards.
Staff would like to consider adding Hotel as a Special Exception t Central Business District
Plan Commissions may recommend amendments to city council fter due consideration of the
following items:
1. the comprehensive plan;
2. current conditions and the character of current structures and uses in each district;
3. the most desirable use for which the land in each district is adapted;
4. the conservation of property values throughout the Jurisdiction; and
5. responsible growth and development.
