RESOLUTION NO. 04 -4257
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPROVING TENTATIVE TRACT MAP 60850 AND CONDITIONAL USE PERMIT
04 -1553, A REQUEST BY PHILIP HUNG AND EGL ASSOCIATES, INC. TO
SUBDIVIDE A 31,764 SQUARE FOOT PARCEL FOR THE DEVELOPMENT OF TEN
(10) DETACHED CONDOMINIUM DWELLING UNITS TO BE SERVED BY A SINGLE
DRIVEWAY OFF OF SULTANA AVENUE. THE SUBJECT PROPERTY IS LOCATED
IN THE HIGH DENSITY (R -3) RESIDENTIAL ZONE AT 5527 -5539 SULTANA
AVENUE. (EGL ASSOCIATES /HUNG)
THE CITY COUNCIL,OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon information contained in the staff report to the City Council and
information contained in the Planning Commission staff report as well as the Planning Commission minutes;
and based upon testimony received at a noticed public hearing before the City Council on April 20, 2004 and
based upon plans submitted and considered by the City Council on April 20, 2004, the City Council approves
the requested Tentative Tract Map and Conditional Use Permit, based upon the findings and subject to the
conditions contained in Planning Commission Resolution 04 -2081 PC plus one additional condition as follows:
a. The two existing Redwood trees, which are situated on opposite sides of the existing driveway,
shall be preserved, if acceptable by the Los Angeles County Fire Department. If for whatever
reason the two Redwood trees cannot be preserved, approval to remove the trees shall be
obtained from the Community Development Department in advance.
SECTION 2. This project should not result in significant effects upon the environment and a
Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial
statement as prepared indicates there is no potential for adverse impact to the environment generally and
specifically as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological
communities, including the habitat upon which the wildlife depends for its continued viability.
SECTION 3. Accordingly, Tentative Tract Map No. 60850 and Conditional Use Permit 04 -1553 are
hereby approved subject to all of the conditions as set forth in Planning Commission Resolution No. 04-
2081 PC as well as the additional condition enumerated above.
SECTION 4. The City Clerk shall certify to passage and adoption of this resolution and enter it into
the book of original resolutions.
