CITY OF MEDINA
RESOLUTION NO. 76. / i
RESOLUTION EXCEPTING SCHUMACHER CONSOLIDATION
WHEREAS, Rodney DSchumacher and Linda K• Schumacher,
husband and wife, are the owners of real estate described as Lots 6, 7, 8
and 9, Block 28, Independence Beach, Hennepin County, said property
being four separate parcels of record prior to the day of , 1976; and
WHEREAS, the said owners have made application to consolidate
the property as follows:
Parcel 1: Lot 6 and the Westerly 40 feet of Lot 7;
said Block 2 8;
Parcel 2: The Easterly 20 feet of Lot 7, Lot 8, and
Lot 9, said Block 2 8; and
WHEREAS, the proposed consolidation will not require additional
streets; and
WHEREAS, the proposed consolidated parcels are served by
public sanitary sewer and water and the owners have requested a fair
division of special assessments heretofor levied; and
WHEREAS, none of said property has previously been the subject
of a division or consolidation under this ordinance; and
WHEREAS, a survey of the property, a sketch of the proposed
consolidation and a concise legal description have been filed as part of the
application:
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina as follows:
(1) That the said consolidations are excepted from
the Platting Code.
(2) Variances are granted from the lot width require-
ments and the area requirements of the Medina
Zoning Ordinance.

(3) A practical difficulty exists in that the original surveys
of Independence Beach contain ambiguities and uncertainties
making it impossible to reconcile the survey lines with
the lot lines established by long usage.
(4) Existing special assessments for public improvements shall be
assigned 50% thereof to Parcel 1 and 50% thereof to Parcel 2.
PROVIDED HOWEVER, that the applicants fulfill the following
conditions:
(1) Obtain a Land Division from the Hennepin County
Finance Department consistent herewith.

PROVIDED FURTHER that no construction permits be issued for
the property until compliance with the foregoing conditions has been demonstrated.
