CITY OF MEUINA
RESOLUTION NO. i -/9
RESOLUTION EXCEPTING THEIS DIVISION
WHEREAS, Fidel H. Theis and Mary A. Theis, husband and wife,
are the owners of real estate described as set forth on the attached
Exhibit A, said property being a separate parcel of record prior to
the 16th day of March, 1976 and
WHEREAS, the said owners have made application to divide
therefrom the following described property:
Parcel 1 : That part of Lot 6 lying North of the South 912. 5 feet thereof
and West of a line drawn South parallel with the West line of said lot from a
point on the North line of said lot distant 116 feet East of said West line as
measured parallel with the South line of said lot, Auditor's Subdivision No.
241, Hennepin County, Minnesota; and, That part of Lot 11 lying North of the
South 912. 5 feet thereof and East of the West 232. 5 feet thereof, Auditor's
Subdivision No. 241, Hennepin County, Minnesota; and, The West 172. 5 feet
of that part of Lot 10, Auditor's Subdivision No. 241, Hennepin County,
Minnesota, lying North of the South 912. 5 feet thereof.
WHEREAS, the proposed divi.s:idn wi.l.l not require additional streets:
and
WHEREAS, the proposed division is served by public sanitary sewer
and water and the owners have requested a fair division of special assess-
ments heretofor levied; and
WHEREAS, none of said property has previously been the subject of
a division or consolidation under this ordinance; and
WHEREAS, a sketch of the proposed division and a concise legal
description have been filed as a part of the application;
NOW, 'THEREFORE, BE 1'P LESOLVED by the City Council of the
City of Medina as follows:
(1) That the said division is excepted from the Platting Code;
(2 )
(3) A practical difficulty exists irl that the installation of the City's

the installation of the access road thereto have created an
impractical separation of the properties making up the said
Parcel 1.
(4) Existing special assessments for public improvements shall
be assigned, 100% thereof to the said Parcel 1.
PROVIDED HOWEVER, that the applicants fulfill the following
conditions:
(1) Obtain a Land Division from the Hennepin County
Finance Department consistent herewith.

PROVIDED FURTHER that no construction permits be issued for
the property until compliance with the foregoing conditions has been
demonstrated.

All of Lot. 6 excerpt that part thereof described as follows:
commencing on the North line of said lot, 116 feet East of the West
line of said Lot measured on a line parallel to the South line of said
Lot, thence South and parallel to the West line of said Lot, 123 feet;
thence East and parallel to the South line of said Lot, 130 feet;
thence North and parallel to said West line to the North line of said
Lot, thence West along said North line of said Lot to place of beginning,
and except that part of said Lot 6 embraced within the plat of Elm
Creek Ridge; and except that part of the South 387.5 feet of said Lot
6 lying West of a line drawn 755 feet East of measured at right angles
to and parallel with the West line of Lot 10, Auditor's Subdivision
Number 241;
All in Auditor's Subdivision Number 241, Hennepin County, Minnesota,
according to the plat thereof on file or of record in the office of the
Registrar of Titles in and for said County.
