HomeMy Public PortalAbout1976-020Member Vakeet rrarile!s,„ introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 76 - 20 RESOLUTION EXCEPTING LOT CONSOLIDATION WHEREAS, Donald E. McCracken and Iva R. McCracken husband and wife, are the owners of real estate described as Lot 4 and the Southeasterly 40 ft. of Lot 3, Block 28, Independence Beach, Hennepin County, said property being two separate parcels of record prior to the 16th day of March, 1976; and WHEREAS, the said owners have made application to consolidate the property as follows: Parcel 1: Lot 4 and the Southeasterly 40 ft. of Lot 3, Block 28, Independence Beach; WHEREAS, the proposed consolidated parcels are served by public sanitary sewer and water and the owners have requested a fair consolidation of special assessments heretofor levied; and WHEREAS, none of said property has previously been the subject of a division or consolidation under this ordinance; and WHEREAS, a survey of the property, a sketch of the proposed consolidation and a concise legal description have been filed as part of the application; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina as follows: (1) That the said consolidations are excepted from the Platting Code, (2 ) Variances are granted from the lot width requirements the lot area requirements, and the setback requirements of the Medina Zoning Ordinance; (3) A practical difficulty exists in that the original surveys of Independence Beach contain ambiguities and uncertainties making it impossible to reconcile the survey lines with the lot lines established by long usage; (4) Existing special assessments for public improvements shall be assigned 100% thereof to Parcel 1.
