HomeMy Public PortalAbout1976-029Member Robert Franklin `r r ter; f -4t1 1Wif `introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 76-29 1 RESOLUTION EXCEPTING LOT CONSOLIDATION WHEREAS, Richard Martin Toomey and Karen Lee Toomey, husband and wife, are the owners of real estate described as Lots 18 and 19, Block 9, Independence Beach, Hennepin County, said property being two separate parcels of record prior to the 16th day of March, 1976; and WHEREAS, the said owners have made application to consolidate the property as follows: Parcel 1: Lots 18 and 19, Block 9, Independence Beach; WHEREAS, the proposed consolidated parcels are served by public sanitary sewer and water and the owners have requested a fair consolidation of special assessments heretofor levied; and WHEREAS, none of said property has previously been the subject .of a division or consolidation under this ordinance; and WHEREAS, a survey of the property, a sketch of the proposed consoli- dation and a concise legal description have been filed as part of the appli- cation; NOW, THEREFORE, BE IT RESOLVED by the City Council' of the City of Medina as follows: (1) That the said consolidations are excepted from the Platting Code, (2) Variances are Variance from front yard requirement to permit house to be no lele than 20 feet from Right-ofway of Beechnut Street, (3) A practical difficulty exists in that the original surveys of Independence Beach contain ambiguities and uncertainties making it impossible to reconcile the survey lines with the lot lines established by long usage; (4) Existing special assessments for public improvements shall be assigned 100% thereof to Parcel 1. PROVIDED HOWEVER, that the applicants fulfill the following conditions: (1) Obtain a Land Combination from the Hennepin County Finance Department consistent herewith. (2) File a Warranty Deed with the County Recorder. (3) PROVIDED FURTHER that no construction permits be issued for the property until compliance with the foregoing conditions has been demonstrated.
