Mayor Stone - I want to applaud your decision, along with other Council Members, not to hold a debate on the question of a 'ceasefire' in the Israel-Hamas war. Such a debate would do nothing to achieve peace in the region. Instead it would take up much of your valuable time and divert the attention of the City Council away from the important and pressing issues that affect the citizens of Palo Alto. I realize that the public is entitled to speak at Council Meetings, but useful publiccomments should be focused on local issues. The individuals who come to the Council to demand a 'Ceasefire' are wrong in their belief that by making a scene or by causing disruptions in debates they can sway thepublic's viewpoint on this issue. They are the same type of people (maybe even they are the same people) who violate the very essence free expression by shouting down speakers who come to theStanford campus to present views they disagree with. I would definitely value an opportunity to meet with you, along with the Police Chief and theCity Attorney, about this important subject. I would also suggest including someone from Embarcadero Media, as they may be interested in organizing future events to foster discourseon community matters. I understand the concerns you express about escalation risk and also about the possible limitations of applying Section 403 in the case of "public meetings." However, if we acceptthe status quo, we have a situation where a determined individual or group can, with impunity, sabotage a lawful gathering of citizens to exercise their own rights of assembly and freespeech. I'd like to work together to find a way to overcome this, so that the free speech rights of everyone -- speakers, protesters, and audience -- can be protected. The protocol you describe of dealing with disruptions by recessing, restoring calm, and thenchanging venue if necessary, does not seem practical or effective in the face of an individual or group who is determined to disrupt. As an example: At the Jan. 31 debate, the moderator --Adam Dawes of Embarcadero Media -- called a recess and tried to restore order, all to no avail. At that point, moving the event midcourse would not have been feasible. With regards to the possible limitations of applying Section 403 in the case of "publicmeetings", I would like to ask if Santa Clara District Attorney Jeff Rosen could opine on this subject. If Section 403 is not the answer, is there another statute that could be enforced? If there is noexisting statute to solve the issue, do we need to enact a new ordinance, either at the State or local level? I am in strong agreement with tenets of the First Amendment -- that the government shallmake no law "abridging the freedom of speech." However, based on Supreme Court precedents, the government does have the discretion to regulate the time, manner, and place ofexpression. And it should be a priority of the City of Palo, in my view, to take vigorous measures to promote free and open discourse for all of its citizens, and to protect them fromthe proverbial "heckler's veto." As a community, Palo Alto places high value on people’s ability to participate in ourdemocratic processes. For this reason, we were happy to accommodate Embarcadero Media’s request to use city hall for the candidate forum. In planning for the event, our staffand event organizers were clear that PAPD would be present to ensure public safety, but not as a substitute for private security that might be needed for the program to proceed asplanned or to manage the crowd or enforce behavioral expectations. A much more effective means to handle such situations is to recess the event, and employeither time for order to be restored, or a change of location for the event to proceed. The City would take similar steps for city council meetings, should this be necessary. We should also note that Section 403, as referenced below, contains an exemption forgatherings related to “public questions”, which would presumably apply to a candidate forum. That exception, which references California Elections Code Section 18340, also setsthe threshold of “threats, intimidations, or unlawful violence” before a violation occurs. This may reflect a recognition that public issues such as elections have on occasion drawndisruptions as issues of intensity arise. I'm sure you heard what happened at the debate. For 45 minutes, dozens of anti-Israel protestors shouted at the candidates and at members of the audience, making it impossible tohear the candidates and forcing the event to be cut short. After the event, I asked the Embarcadero Media Foundation -- the organizer and moderator of the debate -- why the disruptive protesters were not escorted out of the room so that thedebate could continue. The President of Embarcadero Media, Bill Johnson, said they had met with the Palo Alto police beforehand to discuss how disruptions would be handled. Apparently, the police told Embarcadero Media that they would intervene only if there was violence or the threat of imminent violence. This explanation does not make sense to me. The police should have enforced Section 403of the Penal Code, which states: “Every person who, without authority of law, willfully disturbs or breaks up any assembly or meeting that is not unlawful in its character… isguilty of a misdemeanor." I contacted Santa Clara County District Attorney, Jeff Rosen, and he confirmed my understanding of Section 403. He explained that "courts have found violations of the[Section 403] when a person’s conduct--not the content of the activity’s expression— substantially impairs the effective conduct of a meeting in violation of implicit customs orusages or of explicit rules for governance of the meeting, of which he knew, or as a reasonable person should have known." One of the reasons Section 403 is an important statute is that it protects everyone's freespeech rights. Protestors have free speech rights. But so do speakers, and so does the audience. Free speech includes the right to hear what speakers are saying. If we do notprotect everyone's free speech rights, we are giving protestors a "heckler's veto." Can you help me understand why the police told Embarcadero Media that lawenforcement would intervene during the debate only if there was violence or the threatof violence? Why was there no mention of Section 403, which would have been an appropriate basisfor police intervention if circumstances warranted? By not invoking Section 403, the police abdicated its law enforcement responsibility, and did a disservice to the audience, which had a right to hear the candidates. Looking forward, what can be done to ensure that the police enforce Section 403 atfuture events? For an event like last week's debate, I believe the best approach would be for the police to notify the audience at the outset that anyone who disrupted the meeting would be escortedout of the room, and if necessary charged with a misdemeanor violation of Section 403. We will not be able to maintain our democracy if illegal protestors are allowed to drown out our free speech rights. After 112 days of a continuous protest directed at Stanford’s complicity in Israel’s crimes against humanity, including through Thanksgiving and Winter Break, students are now being forced to vacate White Plaza with less than 12 hours notice. This is both unconscionable and unacceptable. The University should not take any punitive action that would infringe upon the rights of of individuals to peacefully protest, engage in sit- ins, and advocate against genocide on campus. The Sit-in to Stop Genocide has previously maintained that they will only end their protest if and when Stanford publicly and irreversibly commits to meeting their demands, including committing to the Palestinian movement to Boycott, Divest from and Sanction Israeli entities and companies complicit in Israeli war crimes, apartheid, and genocide. Alongside over 3,200 community signatories, I hope to see Stanford uphold its principles as an institution committed to freedom of inquiry and expression. The University may try to shroud their complicity in the language of concern for students’ safety, yet this concern was nowhere to be found after countless incidents of anti-Arab racism, Islamophobia, harassment and hate crimes perpetrated against students on campus. In fact, the threat of punitive action against student protestors shows that the Stanford administration is willing to jeopardize the safety and freedom of some students. In particular, considering the diversity of the Sit-In’s movement, the University’s actions will disproportionately harm protected minorities, students of color and international students. I urge you to swiftly reverse course, and uphold students’ rights. What is CPAU’s strategy for enabling that? We appreciate the concerns raised by disruption of the debate, and appreciate your following up to review the role of the City at this event. Given the issue involves both legal and practical dimensions, I am responding on behalf of the City. As a community, Palo Alto places high value on people’s ability to participate in our democratic processes. For this reason, we were happy to accommodate Embarcadero Media’s request to use city hall for the candidate forum. In planning for the event, our staff and event organizers were clear that PAPD would be present to ensure public safety, but not as a substitute for private security that might be needed for the program to proceed as planned or to manage the crowd or enforce behavioral expectations. Among other considerations, this recognizes the importance of not escalating a peaceful protest into a violent or more disruptive incident involving law enforcement officers. You specifically noted that disruptive protesters could have been asked to leave. As a practical matter, the likelihood that such a request would be disregarded presents the prospect of officers needing to make an arrest or more likely multiple arrests. This carries the high risk of escalation, especially when many individuals are involved. A much more effective means to handle such situations is to recess the event, and employ either time for order to be restored, or a change of location for the event to proceed. The City would take similar steps for city council meetings, should this be necessary. We should also note that Section 403, as referenced below, contains an exemption for gatherings related to “public questions”, which would presumably apply to a candidate forum. That exception, which references California Elections Code Section 18340, also sets the threshold of “threats, intimidations, or unlawful violence” before a violation occurs. This may reflect a recognition that public issues such as elections have on occasion drawn disruptions as issues of intensity arise. The City Attorney, Police Chief, and I would be happy to meet with you to discuss this further. Once again, we appreciate your concern for our ability to conduct the people’s business. After the event, I asked the Embarcadero Media Foundation -- the organizer and moderator of the debate -- why the disruptive protesters were not escorted out of the room so that the debate could continue. The President of Embarcadero Media, Bill Johnson, said they had met with the Palo Alto police beforehand to discuss how disruptions would be handled. Apparently, the police told Embarcadero Media that they would intervene only if there was violence or the threat of imminent violence. This explanation does not make sense to me. The police should have enforced Section 403 of the Penal Code, which states: “Every person who, without authority of law, willfully disturbs or breaks up any assembly or meeting that is not unlawful in its character… is guilty of a misdemeanor." I contacted Santa Clara County District Attorney, Jeff Rosen, and he confirmed my understanding of Section 403. He explained that "courts have found violations of the [Section 403] when a person’s conduct--not the content of the activity’s expression—substantially impairs the effective conduct of a meeting in violation of implicit customs or usages or of explicit rules for governance of the meeting, of which he knew, or as a reasonable person should have known." One of the reasons Section 403 is an important statute is that it protects everyone's free speech rights. Protestors have free speech rights. But so do speakers, and so does the audience. Free speech includes the right to hear what speakers are saying. If we do not protect everyone's free speech rights, we are giving protestors a "heckler's veto." Can you help me understand why the police told Embarcadero Media that law enforcement would intervene during the debate only if there was violence or the threat of violence? Why was there no mention of Section 403, which would have been an appropriate basis for police intervention if circumstances warranted? By not invoking Section 403, the police abdicated its law enforcement responsibility, and did a disservice to the audience, which had a right to hear the candidates. Looking forward, what can be done to ensure that the police enforce Section 403 at future events? For an event like last week's debate, I believe the best approach would be for the police to notify the audience at the outset that anyone who disrupted the meeting would be escorted out of the room, and if necessary charged with a misdemeanor violation of Section 403. We will not be able to maintain our democracy if illegal protestors are allowed to drown out our free speech rights. There is a new stoplight at the corner and so called traffic mitigation on the street was completed in the past couple of years. I need the Council to study what has happened to traffic speeds since. The lanes have now moved closer to bike lanes and it feels like you are driving even closer to cyclists in those lanes. However, the biggest problem is the speeding. I feel like I live on a highway. If there is no traffic on the street most cars are literally traveling over 45mph if the light is green. There is a small bump in the road at the light and you can see cars almost go airborne. Please do not wait until there is a fatal accident. There has been at least one so far that I know of that took out the sculpture at that light. This needs to be mitigated soon. ONE suggestion I have for Elon is to make a car with the form factor of a Jeep. Those dothis right- easy to enter and exit. It was quite disappointing. At 1:15 am yesterday, Bhairavi, my wife, woke up and noticed that no crew was assigned to the 284 homes in ourarea. She further noticed that other areas of Palo Alto that were behind us were fixed before ours. So she called the dispatch numbers. No one picked. She then called the City of Palo Altoemergency line and reached a person. That person said he couldn't help because this was a 911 equivalent line. So she kept calling until someone said it would get fixed by 3:30 am. Bhairaviwanted more information. It apparently had nothing to do with parts - they were in inventory. The more helpful dispatcher told us we had to leave the gate open as the power pole was inour backyard, which she did. The final resolution occurred at 2:45 am. Apparently, it has nothing to do with a priority order. Plenty of single outages were fixed before ours in multiple areas of Palo Alto. I would ask thatwe investigate why problems keep happening in our area and why CPAU deprioritizes our area. First, I urge you to act upon the observations and recommendation of Stephen Levy in a recent email: "In light of the recent storms here and in San Diego and Southern California and the SCC alerts we all received, Please remove the tree ordinance from consent and send back to staff for additional analysis. Clearly the assumption that last year’s storms were a one-off is no longer credible. Discuss future weather events with experts and modify the ordinance as appropriate including recent comments from John Kelley and Leah Russin.” Second, current weather reports and newspaper articles, such as those appearing on the home page of the San Francisco Chronicle, not to mention the actual experiences ofnumerous Palo Altans, provide a new basis for questioning some of the information that has been presented to you. The Staff Report #:2310-2190 from the January 16, 2024 meeting stated: "Some of the issues raised during the first year of the updated ordinance centered around the 2023 winter storm season. The series of storms the Bay Area saw last winter was very unusual. The storms included high rainfall totals in very short time spans and strong winds from nonprevailing directions with little or no time for recovery in between events.” This year’s storms suggest that what we experienced last year was part of a “new normal,” not a “very unusual” event. In that regard, we should recall that the worst stormsPalo Alto experienced last year were in the spring, not the winter. Unfortunately, more severe storms may be headed our way later this season. In addiiton, while today’s storm is continuing, there are already reports of (a) numerous power outages, (b) fallen trees, and (c) fallen limbs and branches, as shown in anoutage map and photographs. These limbs and branches are smaller than entire trees, but they are large enough to cause severe damage were they to hit anyone, especially children. While Public Workscrews appear to be responding bravely and relatively quickly during the storm, Palo Alto is simply not immune from the more extreme weather events caused by global warming. Third, the discussion at the January 16th meeting implied that the proposed, amended tree ordinance would not apply to statewide exemption ADUs, but the language presentedto you does not state that. At the January 16th City Council meeting, multiple statements were made to the effect that the proposed, amended tree ordinance included a “carveout” for state exemptionADUs.* (See, for example, the video recording of that meeting beginning at approximately 1:37:00.). While the ordinance allows homeowners, rather than certified arborists,to sign a form currently required by the City, that is a far cry from the proposed, amended tree ordinance stating explicitly that it does not apply to such smaller ADUs. While I it appears that City Staff may have also intended to provide a specific exemption for statewide exemption ADUs in the proposed, amended ordinance, and that CityStaff may also be endeavoring to create a staff-level workaround for that omission, neither of those attempts is an adequate substitute for a properly worded municipalordinance. People reading the ordinance should be able to understand what it means, and that is particularly true for homeowners seeking to build ADUs. It is also important ifthe City Council is concerned about how the tree ordinance will be viewed by the HCD. Conclusion The currently proposed amendments to the tree ordinance fail to protect Palo Altans, they create a series of punitive measures and prohibitions that are the opposite of the typesof well crafted incentives that should guide tree protection in our community, they are at odds with current climate science, and they do not reflect the information that has beenpresented to you and to the community previously. I urge you to please: remove the second reading of the tree ordinance from the Consent Calendar;refer the matter back to City Staff; andencourage City Staff to consult with local design professionals and concerned members of the community before bringing a revised set of amendments back to the CityCouncil.
