moved its adoption:
CITY OF MEDINA
RESOLUTION NO. 76-30
RESOLUTION ACQUIRING LAND FOR PUBLIC PURPOSES
WHEREAS, there is constructed upon Lots 1 and 2, Block 7,
Independence Beach, Hennepin County, certain structures which are in
an extremely dilapidated and hazardous condition; and
WHEREAS, said real estate has become tax forfeit and the City
of Medina's request for a private sale by the County of Hennepin to the
City was approved by the County Board on the 6th day of July, 1976,
at a cost of $1000.00 for Lot 1, and $600.00 for Lot 2, plus $48.00
administrative costs for a total of $1648.00; and
WHEREAS, William E. Fenholt did, on May 16, 1976, offer to
purchase said real estate for $1600.00 plus said administrative costs of
$48.00; did agree to assume financial responsibility for any special
assessments heretofor levied; and did agree to remove all hazardous
structures therefrom; and
WHEREAS, it is in the public interest to correct such hazardous
conditions and to promote the consolidation of such lots into one building
site which more closely approximates the minimum lot size set out in
the Medina Zoning Code;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Medina as follows:
(1) There is a public purpose in acquiring Lots 1 and 2,
Block 7, Independence Beach, Hennepin County;
(2) The City of Medina shall acquire said real estate at a
cost of $1648.00 and the Mayor and City Clerk are hereby
authorized to execute all documents necessary to acquire
said real estate, subject to the following conditions:
(a) William A. Fenholt shall post a cash escrow with
the City Clerk in the amount of $1648.00; execute
an agreement in a form drafted by the City Attorney
assuming liability for the special assessments heretofor
levied and agreeing to remove all hazardous structures
therefrom.

(b) The Clerk shall be directed to publish a notice of
the sale of said lands to William A. Fenholt and
the terms thereof, and to request that any person
wishing to bid a higher price while meeting all of
said terms and conditions, notify the City Clerk
in writing within 10 days of the publication of said
notice, and submit therewith a cash escrow in the
amount of $1648. 00 together with a signed agreement
as set forth in Sub -paragraph (a) hereof;
(c) If any such person shall so notify the Clerk and submit
the said escrow and the said agreements, the said real
estate shall be sold to the highest bidder at auction,
said bidders being limited to those who have posted
said cash escrow and said signed agreements.

The motion for the adoption of the foregoing resolution was duly seconded
by member Arthur Theis and upon vote being taken thereon,
the following voted in favor of: Franklin, Theis, DesLauriers, Reiser
Neddermeyer
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
