RESOLUTION NO'/ . _31/
RESOLUTION ORDERING REMOVAL OF A HAZARDOUS STRUCTURE
AT THE COLONIAL DRIVE-IN THEATRE SITE
WHEREAS,
is the record owner of property located in the City of Medina, Minnesota,
being that part of the north half of Section 12, Township 118, Range 23,
described as follows:
WHEREAS, a building on the above described property consisting of a
shelter for a sewage treatment plant has been damaged by several fires
and substantially destroyed thereby; and
WHEREAS, the remainder of the structure and the sewage treatment
facility are exposed to patrons of the Drive -In Theatre and to others who
frequent the premises; and
WHEREAS, the said remaining structure and treatment facility consist of
pits, holding tanks, piping, debris, and other materials which are hazardous
to persons who may frequent the premises of the Colonial Drive -In Theatre; and
WHEREAS, the City Council of the City of Medina finds that the above des-
cribed structures are inadequately maintained, dilapidated and in a state of
extreme disrepair, constitute a hazard to public safety and a menace to public
health;
NOW THEREFORE,. BE IT RESOLVED by the City Council of the City of
Medina that
shall be ordered to raze and remove the said structure located on the Colonial
Drive -In Theatre site in the City of Medina on property legally described as
set forth in this Resolution;
and that this action is being taken pursuant to Minnesota Statutes §463.15-463.26,
on the grounds that the said building is a hazardous building within the meaning
of the said statute;
BE IT FURTHER RESOLVED THAT
their heirs or assigns must comply with this Order within 20 days from the
date of service upon them or within 20 days file an Answer thereto, otherwise
a Motion for Summary Enforcement of this Order will be taken by the City of

Medina in Hennepin County District Court.
