The Council of Bat Harbour Village met Tuesday, August 25, 1975 at
9:30 A.M. in the Village Hall.
Present: Messrs. Beatty, Printup and'Taplin
Absent: Messrs. Davis and Logan
Also present were Fred W. Maley, Village Manager; Mary T, Wetterer,
Village Clerk; and Thomas H, Anderson, Village Attorney.
On motion of Mr. Beatty, seconded by Mr. Taplin, and voted, the
minutes of the previous meeting of August 12, 1975 were approved as submitted.
Mr. Neil Orange and John Hall, engineers for the water station improve-
ment project, explained to the Council the necessity of separating the 12" and
8" water lines running from Miami Beach and using the 8" line as part of the
distribution system in order to insure water being able to reach the shopping
center in case of a break in the line feeding the system as it now exists.
After discussion on motion of Mr. Beatty, seconded by Mr. Taplin and voted,
Ludovici and Orange were authorized to issue a change order to the contract
which is still open with Widell and Associates to complete the work as out-
lined for the sum of $8,000.00.
Mr. Maley reported that he had made a survey of parking fees in
the neighboring municipalities and determined that our rates are the same
as theirs, for long -term parking, with the exception of the fact that they
issue monthly permits at further reduced rates in remote parking areas. He
felt that there would be no advantage in increasing our rates to raise addi-
tional revenue.
Mr. Anderson told the Council that the Contempt Order in the Giblin
suit is still on record and it was Council's opinion that he try to dispose of
the matter.
Mr. Maley told the Council that Kendall Fill and Dredge Company, the
low bidder on the groins, was having trouble purchasing the liability insurance
called for in the contract which carried the same limits as the original project
bids. After consideration on motion of Mr. Taplin, seconded by Mr. Beatty, and
voted, the limits of liability were reduced to $500,000 /1,500,000 and $1000000
property damage. Mr. Anderson said that he would like to research this to see
If this would affect the contract letting.
Mr. John Thompson and Mr. Joe De Caro of Wilbur Smith and Associates,
discussed the final report on the traffic study for the Bal Harbour Shope
entrance location, and its affect on the intersection at 96th Street and Bal
Bay Drive, plus other consideration. It was the feeling oflhe Countil that
the report had not given enough study to the 96th Street and Bal Bay Drive
situation and suggested that the firm take another look at the problem in
relation to their recommendation that the Bal Harbour Shops entrance should
be moved from Bryon to Carlyle Avenue.
The Village Manager and Village Clerk explained the changes in the
1975 -76 General Fund Budget that had been requested at the first budget hearing.
After consideration no further changes in the budgets were recommended.
The Village Clerk reported that the consideration of the Budget
Ordinances had been advertized as provided by Law and Ordinances 175, 176, 177
and 178 rote read in full by the Clerk.
On motion of Mr. Beatty, seconded by Mr. Taplin and voted
ORDINANCE No. 175
adopting the General Pond Budget for 1975 -76 was passed.
ORDINANCE No. 176
adopting the budget for the Water Department for 1975 -76 was passed on motion
of Mr. Beatty, seconded by Mr. Taplin and voted.

adopting the Sanitary Sewer Department Budget was passed.
ORDINANCE No. 178
adopting the budget for 1975-76 was passed on motion of Mr. Beatty, seconded
by Mr. Taplin and voted.
Mr. John Bruno asked that he be allowed to read a letter from the
Miami Beach Board of Realtors.which appointed him as their representative

=tl,il ')ill including the retainer, less a portion of the amount due to re-
pair the access, for Great takes Dredge and Dock Company and had prepared a
Release of Lien which they were going to have Great Lakes sign to complete
the contract specifications. It was the opinion of the Council in light of
possible damages we might have against Great Lakes that the Release of Lien
be submitted to Mr. Anderson for review and revision if necessary.
There being no further busineso on motion of Mr. Beatty, seconded
by Mr. Taplin the meeting was adjourned at 12:50 P.M.

The Council of Bal Harbour Village met Wednesday, September 17,
19750 at 5:00 P.M. in the Village Hall for the purpose of hearing any ob-
jections to the proposed increase in taxes for 1975 to 6.50 mills which is
11.00587. above the certified millage.
Present: Messrs. Beatty, Davis aiid Printup
Absent: Messrs. Logan and Taplin
Also present were Fred W. Maley, Village Manager; and Mary T.We*_terer,
Village Clerk,
There being no taxpayers present, the Mayor announced that the
final hearing on the millage would be at 9:30 A.M., Tuesday, September 30,1975.
The Village Manager explained that due to the over - expenditures in
the General Fund Budget for this fiscal year an ordinance amending the Budget
